Hi all - Just found out my husband's second application was successful :D so he will be in the UK next week. We had exactly the same financial evidence as before (minus the expenses of the second application) so it is very clear that a mistake was made the first time. Obviously I did also submit a letter addressing the reason for the previous refusal which outlined very clearly exactly how we did meet the financial requirement.

I am still pursuing all the suggestions made here in the hope that we will get something back from the first application, I will keep you updated if any are successful! They haven't asked us to cancel or cancelled our appeal yet but it might just be a matter of time.

Well done. You should now submit an official complaint, requesting a refund of the original visa fee, or compensation equal to the original fee. If you require any help, just let me know. You can ask them for a refund of your appeal fee also, but they will probably ignore it ( on the grounds that they didn't force you to appeal). You can try this email address, but it may not be in use any more

Or contact the appeals Tribunal direct, and ask them how to get the refund. If they will not pay it, then put in a compensation claim to UKVI. Don't wait too long to do all of these things, as there is likely a 3 month time limit on seeking compensation.

Don't worry about withdrawing the appeal. The Embassy will do that. If they don't, it won't matter.

The ECO got it wrong, could have got it right with a little application but could not be bothered or felt it was appropriate to hide behind the protective screen that protects them from direct scrutiny.

There appears to be little appetite to provide even the slightest of assistance even if it makes perfect sense to do so.

What a lot of unnecessary stress and cost!

I would push very hard, including via your MP to get the appeal fee refunded as well. The only reason you needed to appeal was because the ECO made a mistake. Obviously more trouble than it is worth but a point of principle.
