BANGKOK: -- The Sueb Nakhasathien Foundation has asked the Constitution Drafting Committee to amend the draft constitution by bringing back community’s rights in the management of natural resources and environment.

In the petition addressed to CDC chairman Meechai Ruchupan, Mr Sasin Chalermlarp, the foundation’s secretary-general said that the community’s rights in the management of the environment and natural resources in their communities have been deleted from the draft.

He said that the rights should be restored so people in the communities should retain the right to manage, to utilize and to preserve natural resources and environment in their communities.

Mr Sasin further said that the foundation wants the CDC to restore a provision in the draft charter which requires public hearings to be staged and environment impacts assessment study be conducted for projects may seriously affect the quality of environment, natural resources and health of people in communities.

He noted that the right of public participation in the management of environment and natural resources in their communities should be strengthened.

1. No-rights should be restored so people in the communities should retain the right to manage, to utilize and to preserve natural resources and environment in their communities.

But there must be a balance to use or lack of use of natural resources and environment as it may affect a local community, so

2. Yes-right of public participation in the management of environment and natural resources in their communities should be strengthened.

Currently under NCPO Article 44 have lost their right to participation and requirement for comprehensive environmental impact studies.

it's no surprise that this is not in the draft. As you pointed out, the junta already removed the public's rights in this question via article 44.
