Ex-dean of medicine faculty given suspended jailterm for malfeasance

BANGKOK: -- Former dean of the Faculty of Medicine of Nawaminthrathirach University (Wachira hospital) was given a suspended jailterm after he was found guilty of malfeasance by the Criminal Court today (Monday).

The ex-dean, Dr Chaiwan Charoenchoktawee, was accused of using the hospital’s car and equipments such as chairs and sound system at the wedding ceremony of his daughter held at his residence on January 13, 2011.

The National Anti-Corruption Commission later investigated the case and found the accusation against Dr Chaiwan was grounded. The case was proceeded with the court two years afterward.

Dr Chaiwan denied all the charges against him and later made a retraction by confessing to the charges.

The court found him guilty as charged and handed down a five-year jailterm and fined him 20,000 baht. But the imprisonment was halved due to his confession.

However, the court decided to suspend the jailterm for two years citing the defendant’s repentance and willingness to compensate for the damage and for his services to the society as well as the fact that he never served a jailterm before.

A petty case of course....but being the dean of a university faculty with the accompanying reputation.....making the issue a headline event really does seem a little over the top!

The so called Thai 'Justice' system never ceases to amaze me. So he borrowed the car and equipment for his daughters wedding. Hardly the crime of the century is it? Meanwhile back at the ranch, human trafficking, extortions, scams, paybacks, not to mention the numerous murders, robberies etc. on a daily basis.

Anyone looking for a good second-hand digital clock? Govt. House have a few for sale I believe.

Hardly crime of the decade..coffee1.gif I wonder how much public money has been wasted dragging this case through the courts, beggars belief..whistling.gif

For a holder of such a prestigious post to be charged, indicted and convicted over this low level misuse of public funds means there has to be somebody higher up in the food chain pushing this case through the courts.

I would bet a pound to a penny Dr Chaiwan upset some powerful people who then decided he had to be taken down a peg or two.

That is the way it works here.

Exactly. Meanwhile criminal members of the two largest, most corrupt criminals organisations in the country simply get moved to inactive posts until any heat over their crimes die down. That's also the way it works here.

He didn't play ball with someone in power.

Being taught a lesson, Thai style.

He would have been better off killing a policeman while drunk driving, absolutely no consequences there.

........another upstanding citizen.....

....and sentence goes from 'halved' to 'suspended'.....

....anywhere in the world that confessing after the fact is reason to show leniency....

.....charges are laid as warranted by the evidence..

...then the criminal can plead or appeal.....

....but of course....for the sake of pristine pretense....that never happens...

...reputation and convenience before justice....

You dont understand but this is a classic case of the 180 rule. If you are not familiar with the 180 rule I will explain. Basically take a situation and consider the facts. Then look at it totally turned around e.g. some looks petty and should be maybe Baht 1,000 fine then after turn around it is life in prison with a Baht 1,000,000,000 fine. Get the idea?

He upset someone higher up the pecking order. Naughty boy you forgot the brown envelope.

What a joke so called Thai justice steal many millions get moved to a non-active post.

Use a car and a few chairs !! jail time !! ohh you said sorry will suspend jail time.

All you have to do is dig deep find several thousand baht, job done.

Yeah misuse of office equipment which should result in a reprimand from the university board, but hardly something that should involve the NACC or any courts. Don't they have some bigger fish to catch?

you don't catch big fish, you through them bread crumbs

Another early drop out candidate in the contest: "Trust me I am Thai". Wouldn't that be a blockbuster on TV?

Such a horrendous crime that deserves jail time. So much damage and mayhem as a result of his despicable actions! PM should be proud of his country's fair Justice system.

Don't forget that this is the system that had a Prime Minister removed from office because they hosted a cooking show on TV.

When they want you, they get you. Don't forget to wai.
