webfact Posted April 12, 2016 Share Posted April 12, 2016 S44 expected to be invoked to solve 2G network shutdownBANGKOK: -- The National Council for Peace and Order chief General Prayut Chan-ocha has decided to invoke Section 44 of the interim constitution to solve the problem of 2G network shutdown of 900 MHz spectrum on April 14.Mr Takorn Tantasit, secretary-general of the National Broadcasting and Telecommunications Commission, said he expected the S44 to be invoked today (Tuesday) ahead of April 14 when the Central Administrative Court is due to consider a petition of Advance Info Service to postpone the deadline of the shutdown of 2G network of 900 Mhz spectrum due on midnight of April 14.Takorn said that the court had already been notified of planned invocation of S44 to solve the problem so that the ruling by the court in response to AIS’s petition would be relevant with S44.As for the re-auction of the 900 MHz spectrum license which was abandoned by JAS Mobile after the company failed to come up with the required first installment payment, the NBTC secretary-general said that re-auction would be postponed from May 22 to May 27 to allow all the bidders to have enough time to secure bank guarantees.He said that the terms of the re-auction would remain unchanged with the bidding price to start at 75,654 million baht, the winning price submitted by JAS Mobile. Srikcir Posted April 13, 2016 Share Posted April 13, 2016 Prayut has created probably the most bloated and highest paid governments since 1933. He controls both the executive and legislative branches, has a pro-royalist judicial system, and lords over the so-called Independent Organizations. AIS has lodged an appeal against the shutdown with the Central Administrative Court. The General intends to use section 44 to enforce the shutdown, and the court has been told that, in order that its decision does not conflict with the decree. So much for the independence of the judicial system. I did not see anywhere in this story that he intended to force the shut-down. I assumed that it is the opposite, that he will extend the deadline once again. Goes along with his vision of returning happiness to the people.
