Court rejects police's warrant on Southern bombing suspect

Sakarin Karuehat on Thursday was released from a police station in Nakhon Si Thammarat.

 

NAKHON SI THAMMARAT — The military court on Tuesday declined to issue an arrest warrant on a man accused by police of participating in the wave of bomb attacks two weeks ago.

 

Since Sakarin Karuehat was first detained by the military on Aug. 13, the authorities have been fending off accusation that they arrested him as a convenient scapegoat in the aftermath of the spree of explosions and firebombs in seven provinces that left four people dead.

Military court rejects police request for re-arrest of Tesco Lotus’s arson suspect

NAKHON SI THAMMARAT: -- The Nakhon Si Thammarat-based Military Court of the 41st army circle on Tuesday shot down the police request for an arrest warrant to be issued against recently-released suspected arsonist Sakkarin Karuhat.

 

Pol Gen Srivara Rangseeprammanakul, the deputy national police, led a team of enquiry officers in submitting a petition o the court asking for an arrest warrant to be issued against Sakkarin wanted on the charges of possessing explosives, arson and planting a bomb in connection with the fire incident at Tesco Lotus department store in Nakhon Si Thammarat.

 

A new piece of evidence from forensic experts was presented to the court to back up the request for the arrest summon.

However, the military court rejected the police request and suggested that the enquiry officers resort to the normal process of issuing summons to the suspect for interrogation.

 

After the court’s ruling, Pol Gen Srivara told the media that the police would, from now on, shift their focus on a new suspect whose identity was not known.

 

Police have wanted to re-arrest Sakkarin after having dropped the arson charge against him due to the finding of a new evidence – that explosives were used in the setting off a fire at Tesco Lotus – which enable the police to file more charges against him and also make the case to come under the jurisdiction of the military court.

 

A team of Thai PBS reporters went to Sakkarin’s house in San Kamphaeng district of Chiang Mai on Tuesday to try to locate him but he could not be located. The suspect earlier said he would go into the monkhood after his release from police detention.

Sounds like, oh well we couldn't stitch up that guy so find me a new scapegoat.  I want that reward.

Have I got this right,   the military court refused a warrant and told the BIB to go the normal route of summonsing him for interview so the BIB have indicated they'll now focus on another suspect whose identity is unknown   ?

Does this mean they're to  forget about the original suspect and if so what was the fuss about getting a warrant to re-arrest him   ?

As usual it's hard to understand what the BIB are doing and I'm not sure they actually know either.

The story so far...

The police picked sakarin from an oil rig and arrested him for arson.

Then, they discovered it was a bomb and not arson so the charge was wrong. the military went to visit, got very angry, told police to fix it. Police released sakarin because he did not commit arson. 

He went to be a monk.

The police waited a few days for the dust to settle. Now they could arrest  sakarin on the correct charge, a bomb attack and arson.

Though in fact they cannot arrest him because they must have a warrant from military court.

The military court have turned down the request  (even though there is supposedly evidence that he did the bombing ) because of a technical issue. They told the police to arrest sakarin by normal criminal channels, so ,they cannot get a warrant from civil court because of bomb  , but cannot get from military court because technical issue. 

So now the police that are extremely confused "as we all are "

Will find someone new.
