Civilian court restores jurisdiction over security-related and lese majeste offences

65-wpcf_728x413.jpg

BANGKOK: -- In his capacity as head of the National Council for Peace and Order, Prime Minister Prayut Chan-ocha has invoked Section 44 of the interim constitution to restore the civilian court’s jurisdiction over criminal offences related to internal security, Their Majesties the King and Queen and the Royal Family, lese majeste and war weapons.

However, similar offences which occur in areas covered by emergency decree or Internal Security Act B.E. 2551 will continue to be placed under the jurisdiction of the military court.

The transfer of the jurisdiction over certain criminal cases deemed a national security threat from the military court to the civilian court was attributable to the improvement of political situation in the past two years which saw peace being steadily restored and public cooperation with the government toward sustainable development, reforms and reconciliation.

The NCPO’s order regarding the shift of jurisdiction from the military court to the civilian court over certain security-related cases will become effective after its publication in the Royal Gazette.
