Hello everyone,

 

I got a job from an American company that is not legally set up in BKK, thus, they can't provide me with a sponsorship to get a visa. What are my options of working legally for that company? Can I set up a sole proprietorship or something. All I want is just to be able to pay my taxes, get a visa and a work permit. All advice is highly appreciated. Thanks!

The best option would be for the company to set up a branch or regional office here if they want you to work here.

You would not be able to get a work permit, visa or extension with a sole proprietorship. It has to be a registered company.

Thanks! I called some law firms and they told me that as long as I have a visa to stay in Thailand, working remotely for a foreign company shouldn't be a problem (only need a WP if a company is registered in Thailand). What is your opinion on this matter?

There are limitations on the kind of work you can do on a non-b visa for business purposes. Basically it only meant be for meetings, conferences and etc. 

It is also meant to be for those living outside and traveling to here to conduct business.

The company registration makes no difference other than the ability to get a work permit. Any work requires a work permit.

You may also find it difficult to get a multiple entry non-b visa for business purposes.

So, basically, without the company setting up a branch in Thailand there are no legal ways to get a visa and a WP?

Other than you setting up your own company and hiring at least 4 Thai employees there is no other way to get a work permit.

A branch office only requires one Thai employee per foreigner for them to get a work permit and visas/extensions of stay.
