The Supreme Court has upheld two lower courts’ verdicts acquitting former leaders of the People’s Alliance for Democracy of defamation charges lodged against them by former prime minister Thaksin Shinawatra and the now defunct Thai Rak Thai party.
 

The case dated back to the year 2006 when Thaksin and then Thai Rak Thai filed defamation charges against then PAD leaders who included Sondhi Limthongkul, Chirmsak Pinthong, Chai-Anand Samudvanijja, Pramote Nakornthap, Thai Day Dot Com company which operates ASTV TV station, Chintanart Limthongkul, Khunthong Lorserivanich, Manager Media Grup, Ms Saowalak Thiranuchanyong and Panjapat Angkhasuwan.

What is the status on the rule that a person allegedly defamed has to be present in court to lodge his case?

The moment Thaksin absconded from charges that portion of the suit should have been null and void. He was a fugitive on the run therefore should have had no recourse for defamation charges. Also once the Thai Rak party was disbanded the rest of the defamation suit should be null and void. This was the only verdict they could give. Yes I would have thought that the person bringing the defamation action would have to be in court to explain how the defamation hurt him both financially and emotionally.

Taken 10 years ,and 3 courts to sort this out,a waste of both time 

and money,stupid defamation cases are only going to grow if they

pass the new computer crime act.

A completely inane and disfunctional justice system here in Thailand.....nothing to do with Thaksin or anything.....but 10 years for a defamation case to be settled is totally stupid!
