Potential overstay

Featured Replies

Hello all I know there is some form of overstay on my passport and I'm happy to pay.

Basically I left Thailand on the 25th of December and returned on the 1st January 2017 on a new tourist visa.

I was previously on the extension of stay but now know my work permit was cancelled on the 20th December. Soon I will need to go immigration to correctly cancel my old EOS as I did not do this properly.

Does anyone know if my overstay is from the 20th December until today or just from 20th December to 25th December.

Thanks in advance.

W hen you entered Thailand on 1 January 2017 with a tourist visa you got a stamp in your passport that says "ADMITTED 01 JAN 2017 UNTIL <date>"

If the UNTIL date is later than today, you currently have a valid permission to stay and are not on overstay. The previous permission to stay, which was based on an extension of stay, is no longer valid and is of no relevance today.

The single biggest problem in communication is the illusion that it has taken place

Thank you so much but where I'm confused is my work permit was cancelled on the 20th (I wasn't aware of this) but left on the 25th on a flight to Cambodia. I'm assuming this means 5 days overtstay?

A work permit does not allow you to stay in the country. It being canceled does end your permit to stay in the country.

Since you have already left the country and re-entered there would not be any overstay that you could be fined for.

If you were on overstay  it would have been spotted when you left on the 25th and you would have had to pay 2500 Baht overstay fine,

You seem to be getting confused, you are not on overstay now and have nothing to worry about

Even if you were on overstay from the 20-25 Dec it's unlikely to be spotted now

Nothing to worry about,

they might spot it when you plan to get a new work permit.

At that stage they will do a cross check with Labour and might ask you for the THB2,500.- for the period from 20.12 to 25.12.
