Which visa to open a subsidiary in Thailand?

Hi there,

 

I am currently working in Thailand for a Thai company operating under a BOI status ; I have a Visa non-immigrant "Non B" related to my position. I just landed another role from an SG-based company which includes to open a subsidiary in Thailand and perform a BOI registration ; the company is dealing with advanced technology, is well funded, and plan to hire 20-30 Thai nationals in the next 18 months so it shouldn't be a problem.

 

Regarding this situation, my "Non B" will be cancelled few days after leaving my current company so I will need to apply for a visa "B" in order to continue to live in Thailand, then proceed another work permit application to work. During this time, I will have to launch an incorporation process with a BOI registration and complete the whole process within a delay that I believe could be 2-3 months.

 

From there, I will be able to cancel my recent visa "B" + work permit to obtain an additionnal "Non B" + work permit.

 

1. Is the Visa B (Business Visa) the best option to get this done? The website of the Ministery of Foreign Affairs mention an "IB" visa (Investment and Business Visa), could it be considered as an alternative ?

 

2.  Can the Visa B be granted to people operating as contractor or similar for this specific purpose, or does the holding will need to apply for an employment pass in SG as well?

 

3. Can you confirm that the logic described above is correct? If not what would be the easiest / fastest way to proceed?

To apply for a non B visa you normally need a letter of support from a Thai company plus their company documents. As you won't be working for a Thai company (as it won't exist) you will either need to find a company to support a single entry non B or enter on another visa, such as a tourist visa.

 

Whatever happens you won't get a work permit until the company is up and running.

 

There are several well known legal companies that can probably support you with the documents you require.

I would suggest you contact the BOI one-stop center, explaining your intentions. What you are doing is certainly not unique, and they should be able to provide guidance.
