BANGKOK: -- THE PEOPLE’S Alliance for Democracy (PAD) yesterday resolved to file a charge against the National Anti-Corruption Commission (NACC) after it decided to only appeal one of the four acquittals in the case involving the violent crackdown on yellow shirts in 2008.

The Supreme Court’s Criminal Division for Political Office Holders earlier this month acquitted former Prime Minister Somchai Wongsawat, his deputy Chavalit Yongchaiyudh, then-police chief Pol General Patcharawat Wongsuwan, and then-Metropolitan police chief Pol Lt-General Suchart Muenkaew.

They had been found not guilty in relation to the police crackdown in October 2008 that left two people dead and more than 400 injured.

The NACC, as the prosecutor in the case, claimed it had thoroughly reviewed all the evidence and only disagreed with the acquittal of Suchart, who it said had been an operational commander and thus was very familiar with procedures to be followed on the day of the protests.

He also had the authority to issue orders to change the course of action but failed to do so, said the NACC, so it was correct to challenge his acquittal. The PAD, however, viewed the decision not to appeal the three other acquittals as being unjust to yellow-shirt victims.

It claimed this was equivalent to helping the other three, despite the fact that the NACC’s own indictment report made clear that all the four were guilty.

Panthep Puapongpan, a former PAD spokesperson, said the decision not to challenge three of the acquittals would make people believe the NACC’s decision was biased.

The PAD would seek legal options to charge the NACC for the way it had handled the case, he said.

Suriyasai Katasila, the PAD’s ex-coordinator, said the NACC would do everything it could to ensure justice was done.

Criminal Negligence! Criminal Negligence! Criminal Negligence!

Here we go again.

Thanks to the Junta and their charges against Yingluck, every decision made in Thailand is obviously a case of criminal negligence. And now inaction will be viewed as a crime as well. And if/when it doesn't happen, the cry will be "double standards!"

What a lovely future Thailand has...

the violent crackdown on yellow shirts in 2008

Violent crack down ??? Hardly

They took over an International Airport &

Thailand's finest both Military & Police forces did nothing as usual

At the time I was hoping another country would send in helicopter gunships & start clearing the decks

to remove their own citizens trapped there

This is why Thailand remains a backwards cesspool

No elected government can govern a country where the military is in the pocket of the elites

and the police force is just a bunch of self serving extorting criminals

This is how the same group topples the peoples elected governments time & time again in Thailand

19 coups by the same hands

Come on Thai people wake up & take your country back for good!!

There will be no reconsaliation as long political activist don't except Court Deccisions. That why democracy will never works in Thailand. Luckily Thailand have an army who make coups to set clock back  to 00.00 hours.

Ummm Thailand has always been like this. Negligence is a way of life here and most peopleare guilty of it. You only get punished if you upset the wrong people though.

If I recalled the Oct 2008 incident, the PAD lead by Sirichai blockaded parliament to prevent Somchai for making a policy speech as required by the constitution. The surrounded Parliament the night before with razor wire barricades and had several 10 tons truck with speakers and a deluge of provocative speeches and loud music. The PAD was not exactly a peaceful assembly but a violent filled agenda to stop the Parliament session which was illegal. They were never charged for that illegal violent act and we know why.

...and the problem with this sort of make believe is what exactly?

The shoe is on the other foot.

The reason that the three are not being appealed is...

Wait for it...

One of them is Prawit's brother.

Which is why even their supporters (with more than two brain cells) are turning against them.

Just stirring things up so God can have an excuse to delay elections again since reconciliation is getting further away every day.

I mean.....do these people understand how stupid this makes them look.?  Compared to the crackdown against the redshirts they have very little to moan about.  Can hardly acquit Abhisit and Suthep then bang up Somchai and friends.

It just goes to show how much they are opposed to letting Thailand move forward.

Ah no one noticed that one did they.

So who gave the order or was involved with the shootings and the injuries?

I was stuck at the airport for 24 hours by those yellow shirts. Some CS gas, truncheons and rubber bullets would have been justified, pity they didn't use them.

for so much smoke and mirrors here, sometimes thailand is so so obvious

Ah yes, I remember. There was some discussion as to exactly where they "magiced up" so many brand new rolls of military spec razor wire if I recall.
Must have fallen off the back of a passing convoy of large green lorries, as these things do...
