Work permit cancellation dates?

Featured Replies

A very specific question which I hope someone knowledgeable can answer.

My last day of employment at school is next Friday 8th September. I have an extension based on work tied to the work permit currently valid until March 31st 2018. I know that once my work permit is cancelled my extension is no longer valid and I must either get a 7 day extension, or leave the country to get another type of visa. The school is happy to delay cancelling until 20th October (6 weeks later)

I believe that either I or the school can go and cancel the work permit. My question is this, will immigration take the date of cancellation of work permit, as my last valid day on the extension, or the date of leaving school (school is happy to delay cancelling as I said, but believe they will put 8th September as date of leaving work). If I go I would just put 20th October on the form.

I hope that makes sense, advice appreciated.

Last time I tried the Ministry of Labor would not post date a WP cancellation. They said I could only cancel it that day.

But they do not tell Immigration about the cancellation so you can cancel the WP without too much worry even though technically invalidates extension. They told me to cancel it after I returned from Laos...they were OK with that.

You need to get a post dated letter from the school stating your last day at work. You can take that to Immigration and cancel your extension, which gives you time to exit. You should cancel your extension because they are sticklers for that these days.

So just to be clear if the school correctly state last day of employment is 8th September (they are not willing to change that) then this is the date I must get a different visa, date of actually cancelling WP has no bearing. If I stayed the six weeks, even if WP wasn't cancelled I'd technically be on overstay?

That is my understanding, you must exit on Sept 8th if that is the day your school specifies. or apply for extension and get denied and have 7 days to leave for 1900 baht

Sadly for me this is what I thought too. I was hoping to avoid an extra tourist visa from Penang as I am planning on going to U.K. For an OA visa, but my financial proof paperwork will not be ready until early November. I can't afford to spend 8 weeks in U.K. Prior.

I'm in Phuket and prefer to fly not go by road so Penang is probably easiest option [emoji4]

Do not confuse last day of employment, which is the termination of your contract, with the last day of working.

If I go on holiday on Sept. 1 for two weeks and at the end of the holiday my employment is cancelled on Sept. 15 I would be on overstay on Sept. 15, not on Sept. 1.
