Don't submit your application without knowing for sure. You run the risk of the application being rejected.
You can't usually submit further evidence after your application.

She could take it in the UK before returning to BKK. More exam slots available. And you can give her some intensive practice before hand.

Family visit appeals could well be scrapped entirely in 2011/12 according to a leaked UKBA doc.
36% of family visit appeals are successful highlighting a clear problem with ECO decision making.
That said, with the UKBA expected to cut 20% of expenditure I don't see things improving any time soon.

Remember it was found in Pankina [2010] that Policy Guidance does not have the status of law and cannot therefore be used to establish the requirements of the Immigration Rules. Therefore any refusal based on a guidance document is not safe.

You're pretty Dagenham mate if you think that those who work hard in boiler rooms should be praised!
Thread delivers etc
6. you have insulted so many people on this site, your membership should be reviewed
7. If they get work as an English teacher or working in boiler rooms, how does someone that works hard like this become a lowlife in ANYONE's opinion?
You are a fool
Go stick your head back into the hole it came out of.

She wont get a work permit just to work in an advertising firm.
I would conclude differently. OP would have to apply for a sponsor licence for his compaby and wife could apply through tier 2, subject to qualification.
Or the OP could incorporate in Thailand and explore the intra-company transfer route. With a UK corporate tax bill of £100k the company should be able to absorb the required salary.
Go the settlement route would be my advice, even ILE would suit your circumstances, seems you are not interested in securing citizenship for your wife.
I've never bought into the UK being a preferential place to give birth. 50,000 THB full private in Thailand is fine and the level of care excellent. Maternity wards where one could stay for 7 days are an alien concept to Thais.

The only positive thing to add is that you may not have to wait long to qualify by age; the Supreme Court is set to review the 21 rule on 8-9 June 2011.

Long term residents of Cambodia are exempt from the English requirement.
In addition to money, there is another possible (edit) Are you aware that your wife also has to supply a certificate showing that she has passed an English listening and speaking exam at minimum level A1? This is usually the Cambridge KET exam. Is it available in Cambodia?
Hi Crocodile,
There is no speaking exam available in Cambodia BUT this makes the Cambodian citizens exempt.
Since you are talking about the mother of your children, I assume you want her to get "indefinite leave to remain". You really do need to check out the UK Border Agency Website at http://www.ukvisas.gov.uk/en/howtoapply/infs/settlementguide
As of November 2010 she will need a certificate showing that she has passed an English listening and speaking exam at minimum level A1.Cambodia is not on the list of exempt countries.
I am going through this process myself right now with my wife of 11 years who has travelled all over the world with me, including the UK, but as a tourist.

Official TOEFL score report is needed.
Should only take 2 weeks normally.
-
They should put the start date on the visa as 1 month before the course start date on the CAS.
They'll do this automatically, no need to request it. When the student completes their VAF9 put the intended date of travel to UK to include the 2 week holiday prior to the start of the pre-sessional course.

Best to gather together all the supporting docs again and ship with a guaranteed delivery courier such as UPS. Around £60, and fully trackable door to door internationally.
Much cheaper than tourist visa + return flight.
the guy in the post office said the parcel would be there in 6 days, he has sold me the wrong package.just spoke to parcel force they said tuff luck basicly.i sent everything in 1 parcel so my wife could open it and take it to the vfs with out her getting confused of where certain documents would go in the pack.we missed the 2 appointments at the vfs.its going to take me a week or 2 to write out a new pack. could i apply for a tourist visa now so my wife can come here to collect the pack so it wont disapear again?

Parcelforce Worldwide is a brand owned and operated by the Royal Mail Group.
http://www.royalmailgroup.com/portal/rmg
Sorry I beg to differ parcel force have a different website and tracking service they are not combined anymore this government or the last government have cut all the services up. If you do a search you will be took to 2 different website. www.parcelforce.com www.royalmail.่com two totally different websites and companies
-
PF and RM are one and the same.
I too am curious as to why the TB cert was sent from UK?
I always use a guaranteed service, such as UPS. Much more reliable. RM even lost a special delivery from Scotland to London, so if delivery is a must I avoid RM like the plague.

Typical UKBA: one page says the fee is 15k, another 6k!!
-
You should consider informing the UKBA that your marriage has broken down. You are still her sponsor, so best to provide notice, especially as you now want to sponsor a new applicant.

With sending 2-10k emails per month, I'd strongly suggest you invest some money in your email marketing and run a copy of Lyris' ListManager.
Full tracking, dynamic content, proper segmentation, triggers, frequency-actions and limits, and my personal favourite, sales and abandonment tracking (among many, many, many more features!).
Email marketing can be so powerful, but you need to be able to delve deep into the data to maximise your ROI.

From Tuesday the 22nd of March 2011 onwards and until the issuance of biometric visas, four categories of applicants are allowed to apply by post for a short stay Schengen visa without having to go personally to the TLScontact visas centre. Only 1 applies to you. Postal application only possible if you live in one of the following counties:
Cheshire
Cornwall
Cumbria
Derbyshire
Devon
Durham
Gibraltar
Great Manchester
Guernesey
Isle of Wight
Jersey
Lancashire
Merseyside
Northern Ireland
Northumberland
Shropshire
Tyne and Wear
Wales
Yorkshire
You must first connect to the TLScontact Website https://www.tlscontact.com/gb2fr/login.php , then choose the type of short stay visa you need and then answer the questions. If you are eligible to apply by post, the software will give you the choice to apply by registered post. Otherwise you will have to take an appointment at the visa centre in London.
Warning: you cannot send your file by post if you are not registered on the TLScontact website.
Spain
Applicants can no longer go to the Consulate and wait for a first come first served appointment. You can either:
- Send a photocopy of your wife's passport and UK visa to the Consulate and request an appointment; or
- Apply using VFS (in person, London); or
- Use an agent.
2 - 8 weeks minimum to get an appointment. No postal application, so if postal is a must for you, you'd have to use an agent for a Schengen visa issued by the Spanish Consulate.
OT (ish) but maybe relevant to others
I take it you are British? If you were an EEA national living in the UK then technically you need only your passports and a copy of your marriage certificate to gain entry to an EEA state - that carries the risks of you meeting a recalcitrant border official though, so sorting out a visa in advance would be preferable.

You could well consider making a fresh application to find out why his application is being refused.
The 'Community Code on Visas' states that a standard refusal notice must be given to failed applicants. This rule becomes effective April 5, 2011.

With 10s of thousands banked, you really shouldn't run in to too many problems.
If really needed, you could also submit financial statements from your family members too.
You basically need to show you can cover your outgoings and what the UK Govt. considers the bare minimum for a couple: £105.95/wk from Apr 2011. This can be out of income and/or savings. It will take 2 years for your partner to get the right to work, so your finances are judged over a two year period. So, e.g.
Applicant uses savings as maintenance for the whole 2 years
£105.95 per week is a little over £11,000 over 2 years
Rent at £400 per month over 2 years = £9,600
There are no debts =
£21,000 would be sufficient without needing to be employed
(or no savings at all and a job paying £10,500 per year after deductions)
NB. Obviously this would need to be tailored to your own accommodation costs & any debts)
Rented v owned property is a non-issue.
Remember too, any money she has banked will also be taken into account.
Good luck, and with your business too.

Pregnant Thai Woman With Uk Spouse Visa, Marriage Over.
in Visas and migration to other countries
Posted
As with many things, "it depends".
Can't apply for ILR based on marriage.
How much acces does she have with the other child? Is there a contact order?
Regardless, she should not resolve this outside the UK in my opinion.
Dependant on access to the other child (and subject to proof), she could inform the HO of a change of circumstances and apply for access visa under rule 247. Reference to Articles 6 and 8 EHR would be useful too.
If succesfull and 12 month visa will be issued and ILR can be applied for afterwards.
As a last resort, should the applicant fail at any point they can appeal to AIT, claiming Article 8 and referencing Chwimba v SSHD (no need to leave UK and apply for entry clearance if you already have a private life in UK).
Something to consider, with some ifs and buts.
