    Wearing a helmet is important it doesn't matter what the person think if it is required then it is up to the authorities to enforce it which when it comes to Thailand, that is the problem here with most things. 

    In the early 90's, in California I was involved by accident law requiring helmets.  All the excuses were there from groups including the Hell's Angels No way my freedom you hear that a lot even today.  

    The data was overwhelming as to the need,  of course no helmet is going to save you if you are far exceeding the speed limits or driving recklessly as they do here in Thailand. 

    At that time the cost to taxpayer over a billion once the law was implemented and enforced the cost dropped dramatically. It isn't just lives but the greater cost if one doesn't die. 

    The human makeup the tissue around the head is just that cerebral cortex the most valuable area,  reason the helmet is design like a mushroom for that area protection.  Here in Thailand I agree poorly made but something is better than nothing that bare skin dame with protective clothing. 

    One can have a simple accident slip fall hit their head in the wrong spot your number can be up worse yet which are in many cases paralyzed the cost to tax payor is a lifetime. 

    You see the data of death the greater  cost in Thailand not often mentioned the emotional toll if they don't and the medical and dependent cost. 

    Yes,  education is a key and enforcement is part of that education the solution to reducing the problem is simple but as long as Thailand doesn't understand the problem things will never change.  

    The data is there all you got to do is take the time.

    That is very valid, reason why I don't look at new.  Whatever a person just my opinion save going in ground level I rather wait. In new, if timing and allow like to see less dangerous area that might be finished to get a sense of the workmanship and design this allows a sense of future problems.

    New, try to research prior developments, if possible go and pretend you are a potential buyer all the things I wrote earlier will give you a good guess what you just brought into will be like, maintenance, common fee payment etc. and committee how they are form and their strength. Take a hundred owners for example if you get 2 to show up that would be a miracle. Less involvement the more control the management has and if they are what I've seen in Pattaya, that isn't a good thing.

     

    Developers usually go with what and who they know. When you talk about strong committee and I've not seen too many but my experience isn't the final view is that the rules or bylaws the chair should be from one of the owners Thai or foreigners that has the final say and not the management company I'm one that believes they work for you. I've seen too many project where the committee really has no say here these management seem to have things backwards.

    Good luck, personally find your own answers they are there new or not.

  3. With a real estate background when looking at Condos years ago or any development here these are my guidrlines. 

     

    Fees are based on size of units.  I keep the size Complex as small as possible the larger the more problems in all areas.

    When interested I walk and view as much as possible that includes the stair areas this allows me to see for myself how well kept and the quality of building and maintenance. 

    If interested continue if possible if reluctant red flag I want to know how many owner occupy and how many aren't paying their monthly or yearly fee. In my research I've seen complexes where many particularly Thais owners don't pay and nothing is done. This is a major red flag to me one doesn't have to be an expert 2x2 = 4, if can be obtain the accounting of the complex what comes in where it goes out how much and to whom. Writing between the lines can provide a real good sign as to what to expect. Even trying to attend a Condo meeting can be important.  

    You can learn alot on your own first about management on your own. 

     

     

  4. Just like I said why bother with elections.  The coup happen for one reason 2014, to take control prevent fighting from the Red, if the man passes. After it took those who put puppet 0 as the face to reconstruct a constitution that was taken to the big house for approval it was only then a election was allowed to be held as we know now it is just a show for Thais who actually think they have a choice like they did with Pita.

    He isn't the Top cop,  if he was wouldn't be flying around taking on cases that are generating photo ops.  Photo ops is defined as marketing promoting " The Face " which seem to be the agreement that was made in his return.  To think he has made constructive policies that are permanent and effective not in my book.  Just a show as something being done just a Big Joke, part of the art of war philosophy.

  7. I live with Thais,  house they use primer and a flat base a short period mold on the walls for example retaining walls outside. 

    When it was time to paint I didn't like the color I sanded prep and put a primer then painted with a semi -gloss with the color I wanted. Only house on the soi front that shows no mildew. 

    With the hot sun it will happen the paint after five years keeping the same color I use the old color as a primer sand and prep repaint with one coat Semi gloss. 

    Neighbors how the hell he does it so fast my wife just say made in the USA. ????

  8. In the end this is a show since decision has already been given to him. Who are the other 3 candidates and why just him getting the photo op? 

    If not, is he going to take it well being slighted after this exposure he might be Big Joke meaning don't play jokes on him..

  9. To be honest I skimmed through a number of the replies. Based on your comments I will give you my two baht.  I just got finished with my wife business situation which I knew 10 months ago would turn out this way because there are Thais as we know and after the first month this was the perception of the lady who both agree my wife would share the restaurant space.

    In your situation what bothers me in general is so call agents or agencies dealing with Real Estate in Thailand. I'm sure there is some sort of training even licensing but what is a key factor in training and licensing has to do with ethics and disclosure that either the agents here don't understand the language of contract or they know who cares and who is watching.

     

    In California, the major legislature changes in Real Estate was all about disclosure and ethics. 

     

    You landlord has non what is worse the agency not sure if agency is representing the landlord solely or the entire complex. 

     

    The catch for me with your story is there is no cleared mentioned as to if repairs are needed what are the limits before the tenants starts to pay plus there also doesn't seem to be clear conversation as to what is your responsibility and the landlord.  I own rental here one recently the tenant and wife got into a beef someone broke the toilet I happen to have a extra so prior to replacing I told him next time it is on you.  Things are made cheap in China and it seems the worse of stuff is sent here.

     

    As for your lawyer originally, I have a big problem with one advising you to take it to court when the contract states Arbitration. What I do know lots of stuff like contract like laws here which there are millions but very few are enforced. You can get a Thai rental contract anywhere Big C, stationary dept it might list Arbitration but I wonder if there is actually a process if so how long will it take? There are lots of lawyers here that have no ethics, just as bad any amusement park that want to charge you duel pricing. 

     

    When it comes to Lawyers someone mentioned don't waste your money but in the same breath advise you to let your Thai wife work with a lawyer. Unless you Thai wife comes from a International school land extension dealing with the West. She is going to be clueless with the Thai law and fall into the group " This is Thailand "  meaning they do as they like which is what your landlord and agency is doing.

     

    I would look for a lawyer that would proceed with the verbal process first be able to explain to you the arbitration process, contact both the agency and landlord, have a firm conversation with them first. Why many Thais like your landlord never been confronted with the law so they do and push people around because no one has ever stood up to them. Only after these avenue have been taken explained to you in good enough English to decide to move forward in the courts. Remember you might win but how are you going to collect you can scrape the bottom of <deleted>ter so clean.

     

    There is always talk they know someone even some who say I'm mafia, I've been here so long personally I don't give a rat ass who you know or related. I once was told " I'm Mafia " I take nothing for granted don't disrespect anyone or their mafia but when I was told like him I do some research right off the bat if one is mafia even it a lowly soldier they don't live in a tin can roof.

     

    As for landlord knowing police like many they think every foreigners is stupid we are guess scare <deleted> so many do know friends or friends doing it for friends and not within the oath they have been sworn. In the past, I've been confronted before proceeding I ask for identification and their station if not conversation over. They are acting independently if you confront them challenge them respectfully I sense they will back off.

     

    Your situation is not good there is a lost for you whether you want to accept it or not. I would search quickly for legal advice majority of the ones I have spoken to do it for free. Obtain one that in my opinion that will take the verbal route first. Meantime nothing is going to change with this women until a lawyer has a a good conversation laying out her obtains along with speaking to the agency both have already violated the contract if push come to shove if in court personally damages can be awarded. If the agency represents the complex the owners should be given noticed to the situation by a lawyer.

     

    Meantime you have an urgent situation if the agency doesn't represent the complex and you want to stay look for another rental and don't make the same mistake you did the first time. If the agency does then start to look elsewhere before your family comes.

  11. Rules are the same applications is another matter. As a former Real Estate licence holder 30 years who mainly manage and rented out property. 

    A contract is a contract. 

    You mentioned there is no wording but noted a one year contract!

    On that contract should be a date start to finish if so that is the wording! 

    Deposit normally aren't allowed to be used as rent. 

    In a situation like your contractually if you you are on hook for the rest of year.  But being reasonable I've had tenants in the past for whatever reason want or need to leave. 

    I explain the contract obligation then tell them My obligation is to do everything to rent the unit out again with their help to be able to show it with short notice work together meantime tenant must meet the contract terms which is pay the rent.  I've not or never if it is a good unit priced reasonable find another willing tenant.

    Let me stir the pot a bit since I started the conversation.  No doubt there are people who want to be spoon feeding guess that is why there are visa agents or the reason so many never do any research come on Asean and ask the same questions over and over again. 

    As for bashing I can say Im one of them what else to do that take someone weaknesses and have a good laugh on them. But note me and others who I think is a great majority of this board take any thread daily and if your eyes are open will see.  One thing I don't go to sleep thinking tomorrow is Thai bashing day there isn't one individual who can make the claim they don't. 

    Then a minority that got their heads in the sand think they love the place so much want it to stay as it is selfish reason because then the exchange rate will always benefit them. Their love or like fluctuate with the baht. 

    Personally, I'm not been pamper since 2007, as often it takes I've gone down religiously and did what I needed myself driving my motorbike Darkside near the Lake rain or shine standing in lines being abused verbally by staff at the door because I wasn't standing correctly at the moment. I never had a problem I like to interact and watch people going down watching is very entertaining.  Now with the 90 online working so well at times I get a smile when my application get rejected. 

     

    in spite of my cheerful and patient demeanor no problem with going to Jomtien I stand whole harded the facility itself too small and location to be too conjested for my taste. 

    In the end I've not degraded,  called anyone names or argue with them they must side with my views. ????  If they moved it anywhere they got me and everyone that need the Services will need to follow or start using spoon feeding methods the only way that is going to happen is they move immigration up the man's butt T49 has his limits LOL
