House Speaker Clarifies His Role in PM Vote Session
bradiston replied to snoop1130's topic in Thailand News
Sure, he made the wrong decision in opening up the debate on Pita's renomination to a rigged, doomed, vote. But it was MFP's part to lodge an objection if their lawyers (they have got a legal team, right?), had been awake and on the ball and knew their stuff. That a right wing conservative lawyer who helped write the 2017 constitution that set up the Bentstate, had to step in to point out the vote was completely unconstitutional and the coalition parties should imnediately petition the CC to have the whole farce deleted, says a lot about the coalition's ill preparedness and overall naivete. Incompetence even. If they don't know how to fight, what hope is there? Even now, they're not going to go to the CC. Door mats! And see the article "Speaker defends second Pita vote" in an unlinkable source. The coalition has a DUTY to take this to the CC as otherwise it will form a precedent. -
Pheu Thai will try to get its candidate selected as PM next Thursday
bradiston replied to snoop1130's topic in Thailand News
Good point. It's been targeted with a massive misinformation campaign by certain powerful actors in the senate as being disloyal, seditious, and an attempt to overthrow democracy. It's nothing of the sort. Simply an amended version, copies of which have been widely distributed for anyone to read, and which would have to be debated and voted on by the lower house. Not much chance of getting it through without a house majority in any event. But it terrifies the old lags in the Senate. They don't get to vote on parliamentary business, apart from the rare instances like this one, so they can't control what goes on there on a daily basis. -
Move Forward will support Pheu Thai PM candidate
bradiston replied to snoop1130's topic in Thailand News
If PT has the support of MFP, it will be unacceptable to the Senate. They've already said, no MFP involvement. Can't see how parliament can keep functioning in that case. It's completely unconstitutional. The coalition should petition the CC to stop the Senate meddling in the lower House's affairs. That isn't their remit. Sure, they unfortunately get to vote, but that's the end of it. They don't get to set policy, vet members or any of the other actions they're crossing boundaries to do. Way out of order. But Thailand seems devoid of any procedures to prevent this happening. Where are the checks and balances that work in the people's favour, not just the elitist hysterical screaming queens in the Senate? -

So 224 (to escape the censors) wasn't the only issue? No, the hate campaign and the disinformation campaign unconstitutionally and libellously run by the Senate against Pita and the MFP maybe had something to do with it. And PT's notable absence of any support for certain MFP policies. If they're that chicken, they're not fit for government IMHO. You dump your friends at the first sign of trouble. You wouldn't want to go into battle with that lot, now would you? Join the rest of the yellow bellies. -
I've never ever seen an election held with such obvious disinformation and hate campaigns as this one. The attacks on Pita and his party by some rogue lawyers, serial petitioners et al are mind boggling. He's out to overthrow democracy (as junta-appointed Senator and businessman Seree Suwanpanont remarked, “It’s clear that this operation is aiming to overthrow [the monarchy]. How can we, the senators, support you to do this?”); then "Move Forward’s persistence on Article 112 has been matched by equal conservative resistance, with dual challenges from Thailand’s Constitutional Court, arguably a defender of conservative interests, on grounds of lèse-majesté and a petition filed by conservative activist Theerayut Suwankesorn." And then there's serial petitioner, aka vexatious litigant, Ruangkrai Leekitwattana gleefully waving his sheaf of petitions and share certificates, and threatening anyone backing Pita with a suit of malfeasance. This is just a dirty war they are waging. I really hope it comes back to bite them. Hopefully one day, Pita will be able to sue THEM for defamation and massive damages. They've kept him out of office, and his party out of government . What's that worth? https://www.nationthailand.com/thailand/politics/40029504 https://www.geopoliticalmonitor.com/pita-touches-the-third-rail-of-thai-politics/

Jumping the gun slightly, aren't we? First off, Pita I believe has been urged to file a case stating his disbarring from being renominated was unconstitutional. This advice came from at least one of the lawyers who wrote it the 2017 constitution. See Borwornsak Uwanno in the BP. Second, the case against him for holding shares in a media company brought by Ruangkrai Leekitwattana has yet to be ruled on. Third, the case against him brought by Theerayut Suwankesorn, accusing him of trying to overthrow the constitutional monarchy under section 49 has similarly yet to be heard. My advice? Counter sue for defamation in at least 2 of these cases!

Follow up. You're certainly right in some respects though. Borwornsak Uwanno, a co-drafter of the 2017 Constitution, was educated in part in Paris and Nanterre, and boy, did he come back to shaft the Thai public. But he seems to have had a crisis of conscience and is now one of several Thai constitutional lawyers who are saying the vote against Pita's renomination was unconstitutional. Completely out of order, in other words, and just another glaring example of parliamentary bulldozing/strongarm tactics. -

Seems my copy's out of date. "Rules of Procedure of the House of Representatives B.E. 2562 (2019) -------------------------------------------- By virtue of section 128 of the Constitution of the Kingdom of Thailand, B.E. 2562 (2019), the House of Representatives hereby issues the Rules of Procedure of the House of Representatives as follows: Rule 41 Rule 41 In the case where the Speaker decides that the complaint and supporting explanations are under Rule 39, he shall carry out the publication of the explanations by notifying it at the precinct of the House in order to be inspected by the public within the period of seven days and also publish the explanations in other method as he thinks it is appropriate." Er, hello? Any update on this? Hello? Tap tap tap. Is this thing working? "The party to the first part shall hereinafter be called the party to the first part." Groucho Marx, genius. -

I don't believe there should have been a vote on this. How extraordinarily crass of the coalition to allow it to go ahead. The Speaker should have ruled on it. It wasn't a parliamentary motion. It was the resubmission of a PM candidate, parliamentary procedure. https://www.nationthailand.com/thailand/politics/40029285 "However, The Constitution does not restrict the number of times a PM candidate can be put forward for a vote." -

Impossible to prove something will never ever happen, and futile. But look at it another way. Why isn't there then a clause in the requirements section of the Thai civil service qualifications requirements sheet that says: UNDER NO CIRCUMSTANCES WILL A WEALTHY THAI CANDIDATE WITH AN OVERSEAS EDUCATION BE CONSIDERED FOR THIS POST. THE REASON BEING, HE CAN'T BE TRUSTED NOT TO SCREW THE LIVING DAYLIGHTS OUT OF THE THAI PUBLIC. APPLICATIONS FROM WEALTHY THAIS EDUCATED SOLELY IN THAILAND ARE WELCOME. Bank details to follow. Yeah, the hell he can! -
No, it's unelected. They're selected by a panel of military top brass. The more I read, the more it takes my breath away. Smirking Prayuth seems to have had it away on his toes. Anyone seen him lately?
-
I would also challenge the legality of Senators rejecting MFP's nomination on the basis of their proposal to modify 112. They are not supposed to take sides or be involved in party policy. Yet many have openly stated they would veto any coalition candidate one of whose constituent members proposed even amending 112. It's blatant interference. Gerrymandering. Call it what you will. It's not legal!

Exactly. There are so many unanswered questions about the shares. When were they released from probate, also. A half decent lawyer should be able to make mincemeat of the court stooges. Power to Pita! -
I hope he does. It should never have been put to the vote before the crony court of Senators. It was a parliamentary procedural matter and should have been ruled on by the Speaker, who should have known what the correct ruling is. This one obviously doesn't. MFP is suing the EC for other reasons. Maybe this would fit in nicely in their case alleging unfair treatment of Pita.

Not sure to whom the candidates' names are submitted. But yes, nominated by Pheu Thai leader Chonlanan Srikaew.
-
I think Prayuth installed a 10 man committee to select the Senators. "The proposed constitution also allows the NCPO to appoint an eight to ten person panel who will choose Senators,[4] to include six seats reserved for the heads of the Royal Thai Army, Navy, Air Force, and Police, plus the military's supreme commander, and defense permanent secretary." https://en.m.wikipedia.org/wiki/Constitution_of_Thailand Scroll down to 2017. A military dictatorship posing as a democracy. Of course, with the demise of the NCPO, who knows what will happen in May next year?
-
You may be right. As usual, it's all shrouded in mystery. I use the following source https://www.nationthailand.com/thailand/politics/40029285 It's interesting they say quite clearly there are no limits on the number of times a candidate can be put forward, completely contradicting the farcical vote taken yesterday.
-
Or in a coalition to nominate the PM. So PT will have to dump MFP and collude with the enemy, BJT et al. Unless they grew some balls and stuck by their MoU with MFP. Anutin has said he's not interested in a minority government, ie with a minority coalition of maybe 184 seats, without PT. So there would be a standoff, with the MFP and PT coalition refusing to budge.

I meant, was his name put forward?

I'm not sure Prawit is even a candidate. Anyone?
