If me and wife agree to divorce at local office, is it a generic form that needs to be signed or does it have to be done with solicitors and agreements. If just a generic form with no conditions, how much does it cost.

how long is a piece of string question this is. circumstances? children? where are you at the moment (in thailand or OS?) length of marriage? where were you married?
based on the OP somewhere between 20 Baht and xxxxxx Baht.
sorry... we need a bit more info to give you a 'rough' idea.....
beware of PM's though, they will come, fishing for business.
most important is, where are you now?
the rest i asked is near as important too.
I'm in Thailand, 2 kids daughter 12 living with me son 3 living with her. Married for 15 years, got married in Thailand. I'm in the house which is in her name but I paid for and would like to stay in.

Does anyone know how much it would roughly cost to have my divorce go through court.

Where you married at the time of birth? If yes you already have shared legal parental rights with the mother.
Yes married before birth. But wondering if we were to divorce in court and daughter chooses to be with me, can I be awarded soul custody, baring in mind that I'm not Thai, and on a Non B visa.

Can I get legal custody of my daughter. She's 12. And wants to be with me?

Nicelee808 Do you have your sons birth certificate?
Do you have a Tabian bahn?
If you have both these documents, you can enroll your son in the nursery.
This info is correct, i just asked my school director wife.
Yes I have birth cert. And copies of the tabien bahn not the book and it's in wife's name

who in their mind thinks about that when everything is rosy and new ?
ex lawyer at court : do you have proof on paper, bank transferts, that you gave money, monthly to your wife ... yeah right
All the money I have spent in the last 8 years of living here is probably about 6 million. Transferred from my UK account to my Thai account

Somehow I'm still with my one (just) she's stole money from me 3 or 4 times (and I'm not talking tiny piddly amounts like 20k baht either) even stole watches to pawn them, hanging in there for the kids, plus very restricted as to where one can go now of course.
Worse day of my life was meeting her. I'm gutted how it's turned out, but it is what it is, as they say these days.
Yeah it's nuts. Thought we were fine for years. But then started showing her true self

When was the land purchased?
The land was bought before we were married. But just checked the house book. Her name has always been my name so house book was made after we married. I'm on the house book as father of kids

I don't have anything for the house in my name or any agreement. My wife is at her mum's. The house was built around the same time as we got married. Can't remember if was before or after, was about 16 years ago
I think I would win my daughter in court as I have a salary and wife doesn't, and she hates her mum

Do you have a usufruct, a lease or any other real or contractual right to be in the property? Did you build the house before or after you married?
If you do not have any written rights then you are on shaky ground while your wife is on very firm ground. If you built the house after you are married you can argue that the house and perhaps the land is common property and that you have a right to be there until the divorce is finalised.
The problem with your position is that your wife can wait until you leave the property, close the gates and change the locks. If you try and force your way back in you will be fighting a losing battle.
It would be much worse if your wife was smart and she leased the property to a third party. If you forced your way back into their leased property matters could get extremely serious. Remember that people can be licensed to possess a firearm at their property to protect their life and property.
Up to you how hard you push, but personally I wouldn't stay where I wasn't wanted. Save your energy for the fight in Court.
If the Court grants you the right for your daughter to live with you then you will probably also get the right to remain in the house with your daughter until she reaches the age of 20.

Hi all.
Me and wife have split up. I'm in the home which I paid for but in her name. I'm living there with my daughter, she's 12 and wants to stay with me. Can my wife have me kicked out by the police or would she have to divorce me first.

Thanks for the replies. My plan is to get my youngest too, he already prefers to be with me and my daughter, it's just before bed he asks for his mum. My kids are all I need in this life, I'm not sure if a custody battle will happen, because I don't think my wife is that interested in having them, but I hope to remain in the house, only I have a salary if that would influence a custody battle. We also have farm land all in her name.

Hi all,
I was looking for a law forum, but this is about the closest to my problem.
I have been married to my wife for 15 years, we have 2 children, we recently split up, my oldest daughter is 12, she is living with me because she hates her mum, my son is 3 and with his mother for now. Me and my daughter live in the family house which is in my wife's name, my wife is at her mum's. I am a teacher with non B visa and work permit my wife doesn't have a job. There has been a lot of arguing between me and my wife and my wife and daughter, my wife used to be on drugs, but I'm quite sure she has stopped, but yesterday an arguement escalated as they usually do and she threatened to plant drugs in the house, call the police and said they would arrest me, the crazy thing is she did it via text message which I have taken screenshots of.
Any advice appreciated.

Yes i understand. Thats what i hate too. But think like this, you can tell your school that you have to do this and can teach online from hotel. Students can use the school computer like 5 student to 1 com. just bring your books and things you think you will need with you to the hotel in laos and thailand.
in this matter, i think if your coming from a safe country like thailand and laos and if you have covid free certificate.. you should be free to enter without any problem. Because you have work permit, family... and your not covid. Im sure they will do something about this.
Thanks, is there a website to arrange the quarantine. And how does it work go into Laos and they take me to the hotel get cert. Come back and taken to another hotel. What about prices

I was in your shoes once. About non-o and non-b. The reason why you cannot change it to non-b is because your entry is not for working but family matters. You can work with non-o but they think you will extend it or likewise. I know its funny. but... amazing thailand.
The best thing you can do is.. wait for the end of july, go to Savanakhet and get another non-o. Not non-b. why? it happened to many of my friends. Most likely school will not keep you long time. I mean 1 or 2 years. After that you have to leave the country in 24 hours if you have non-b but if you have non-o you dont need to leave the country and look for another job. Also when you leave to get a new visa at savanakhet, they wont give you another TR visa. it happened to one of my friends at my company.
good luck
Go to Savannakhet is an option but I only need to get a temporary stamp to apply for non b internally. So literally out and back in. But it's the quarantine that I will have to do. So quarantine to go out and quarantine to get back in.

You can but you have to be on a visa exempt or tourist visa.
You can apply for an extension of stay based upon teaching with a non-o visa entry. That does not change it to a non-b visa entry.
Yeah we spoke about it. Went to Ubon immigration to do exactly that and they said no, told me gotta go out get a stamp and get non b.
-
Seems a bit strange why can't just get a non B internally

I have been told that I should be allowed to extend from my Non O to an extension based on teaching but local immigration said to get an extension based on teaching need a non B first. But now with the covid and quarantine. A bit impossible for me. So I will either have to go back to England or refuse to leave. Go to court maybe fight my case on human rights. Lol. No jobs in England family will starve with out my salary here

According to Immigation Law, you can get a non-imm based extension if you are already here non a non-imm stay (which you are). The problem is, most IOs won't do it unless you use an agent - and it doesn't come cheap.
Yeah. Been told that before. And yeah Immigration refused to change from Non O to Extension based on teaching

If your salary is at least 40k baht per month, you should be able to use this for your extension to stay with your wife. There is no need for 400k in the bank (though immigration prefer that) or for income to come from overseas. Which immigration office are you dealing with? What is your nationality?
Don't have that
