US Congress members have formally requested that Prime Minister Srettha Thavisin release Vietnamese activist Y Quynh Bdap and assist in his resettlement to a third country rather than deporting him. This appeal was based on a letter signed by Michelle Steel, Luis Correa, John Moolenaar, and Chris Smith dated Friday, July 26. Activist 32 year old Bdap, who founded Montagnards Stand for Justice to advocate for the religious freedom of ethnic minorities and Indigenous people in Vietnam’s Central Highlands, was arrested in Bangkok last month. Christian Montagnards, who practise their faith in independent house churches, have faced longstanding persecution by the Vietnamese government. Since 2018, Bdap has been residing in Thailand and has been granted refugee status by the United Nations High Commissioner for Refugees (UNHCR). However, he was detained in mid-June and is currently held in Bangkok Remand Prison awaiting a decision on his potential extradition. The Criminal Court has set hearings for tomorrow and August 19 to consider testimonies from state prosecutors and defendants. The Vietnamese government has charged Bdap with terrorism following deadly riots in Dak Lak province in June. Despite these charges, Bdap’s involvement in the riots is questionable as he was in Thailand at the time. Bdap’s arrest occurred after an interview with Canadian authorities at their embassy in Bangkok concerning his refugee status in Canada. Kannavee Suebsang, a list MP for the Fair Party, emphasised the necessity of protecting Bdap and other Vietnamese refugees facing life-threatening risks. “I urge the (Thai) premier to urgently take action to show leadership and understanding in the context of humanitarian and human rights.” The National Human Rights Commission (NHRC) has also called on the government to refrain from deporting Bdap due to concerns over his safety, reported Bangkok Post. UPDATE: NHRC urges Thai govt to stop deportation of Vietnamese activist The National Human Rights Commission (NHRC) urged the Thai government to halt plans to deport Vietnamese activist Y Quynh Bdap, expressing concerns for his safety. Police arrested 32 year old Y Quynh Bdap in Bangkok this week. He is a prominent figure within the Montagnard ethnic group from Vietnam’s Central Highlands and co-founded Montagnards Stand for Justice, an organisation advocating for religious freedom. Christian Montagnards, particularly those affiliated with independent house churches, have faced persistent persecution by the Vietnamese government. Living in Thailand since 2018, Bdap holds refugee status granted by the United Nations High Commissioner for Refugees (UNHCR). The Vietnamese government charged him with terrorism following riots in Dak Lak province in June last year, although his exact role in the unrest remains unclear. Reports indicate that Bdap was taken into custody on Tuesday after meeting with Canadian authorities at their embassy in Bangkok to discuss his refugee status in Canada. NHRC has intervened following a request from a civil society organisation to prevent Bdap’s deportation, arguing that he risks severe danger and an unfair trial if returned to Vietnam. In a formal appeal to the Immigration Bureau, the commission emphasised adherence to the Prevention and Suppression of Torture and Enforced Disappearance Act 2022, which prohibits refoulement, the forcible return of individuals to countries where they may face persecution. Thailand has international obligations under the International Covenant on Civil and Political Rights and the United Nations Convention Against Torture, both of which it is a signatory. Human Rights Watch Human Rights Watch (HRW) has echoed the NHRC’s call. Elaine Pearson, Asia director of HRW stated that Thailand needs to meet its obligations to protect refugees and demonstrate it deserves a seat on the United Nations Human Rights Council. Thailand is currently campaigning for a seat on the United Nations Human Rights Council for the 2025 to 2027 term, with elections scheduled to take place in October at the UN headquarters in New York. Mary Lawlor, UN Special Rapporteur on Human Rights Defenders, wrote in a post on X on Thursday that if Y Quynh Bdap is deported, Thailand would not be fit to be elected to the council. HRW recently published a report criticising Thai authorities for aiding neighbouring governments in taking unlawful actions against refugees and dissidents, thus increasing risks for those fleeing persecution. The report highlighted instances of transnational repression where foreign dissidents in Thailand have been traded for critics of the Thai government abroad, reported Bangkok Post. ORIGINAL STORY: NHRC demands justice for nine missing Thai activists The National Human Rights Commission (NHRC) called on the Ministry of Justice to take decisive action regarding the disappearance of nine Thai political activists who vanished after seeking asylum in neighbouring countries. Sayamol Kaiyoorawong of the NHRC disclosed that she recently handed over an investigative report on these disappearances to Somboon Muangklam, adviser to Justice Minister Tawee Sodsong and chairman of the committee on the Prevention and Suppression of Torture and Enforced Disappearance. The report details the cases of activists who went missing in Laos, Cambodia, and Vietnam between 2017 and 2021. The missing activists are Ittipon Sukpaen, Wuthipong Kochathamakun, Surachai Danwattananusorn, Chucheep Chiwasut, Kritsana Thapthai, Siam Theerawut, and Wanchalearm Satsaksit. Tragically, the bodies of Chatcharn Buppawan and Kraidej Luelert were discovered encased in concrete along the Mekong River border with Laos in late 2018. All these individuals were either implicated under the Computer Crime Act, Section 112 of the Criminal Code, commonly known as the lese majeste law, or accused of actions undermining political stability. The NHRC criticised the Thai government for its lack of progress in investigating these cases, suggesting that state agencies might be implicated due to their negligence. The NHRC’s investigation revealed that state agencies had failed to collaborate effectively with neighbouring countries to uncover the truth about the activists’ fates. The commission stressed the necessity for these agencies to follow legal procedures, determine the reasons behind the disappearances, and bring any responsible parties to justice. The NHRC also emphasised the need for the government to compensate the families of the missing activists, as mandated by the International Convention for the Protection of All Persons from Enforced Disappearance and the Prevention and Suppression of Torture and Enforced Disappearance Act 2022. The NHRC noted a gap in the Damages for the Injured Person and Compensation and Expenses for the Accused in Criminal Case Act 2001, which lacks criteria for government compensation in cases of enforced disappearance. The Deputy Commissioner of the Royal Thai Police (RTP), Surachate “Big Joke” Hakparn, changed his name, adding one more letter for better luck. Big Joke was recently removed from his position following an alleged involvement in a gambling and money laundering operation. It is alleged there were financial connections between him and a gambling network. The deputy commissioner denied all the allegations and claimed that a conflict within the RTP led someone to undermine and ruin his good name and reputation. These allegations affected the outcome of a promotion as RTP commissioner during the recent selection last year. Big Joke refused to step down from his position, continuing to fight for justice. He has called for an investigation into the legality and fairness of the order to remove him but there have been no public updates on the investigation as yet. This is not the first time Big Joke has faced career challenges on his path to becoming the RTP Commissioner. According to a report by The Standard, he was accused of accepting a bribe in a human trafficking case at a karaoke bar in Isaan in 2010, though he was later exonerated. In 2019, Big Joke was reassigned from his role as Director of the Immigration Bureau to a position as an advisor to the Prime Minister’s Office. He was appointed as an assistant to the RTP Commissioner in 2021 and subsequently became the RTP Deputy Commissioner. Big Joke faced another issue in 2023 after his home was raided due to his alleged involvement in the gambling operation, and his financial transactions, which were allegedly connected with the gambling ring, were found this year. After multiple crises in his life, Big Joke decided to seek better luck with a new auspicious name. In Thai, his former name was spelt as สุรเชษฐ์. For his new name, Big Joke added one Thai letter, “ช”, making it สุรเชชษฐ์. Several news agencies raised questions about the pronunciation of his new name. Some speculated that after the change it would be pronounced as Surachatesa or Surachaechot. Pattaya police arrested a group of teenagers, aged between 14 and 16 years, for possessing samurai swords and other weapons. The incident took place yesterday around 6pm near the Dongtan substation of Pattaya Police Station. Among the confiscated items were three samurai swords, each measuring between 30 and 50 centimetres, six pocket knives, and three brass knuckles. The teens, comprising six boys and two girls, were found mingling with tourists when the police arrived. A tip-off from a vigilant citizen, who noticed the teens brandishing the weapons, led to the swift police response. Upon arrival, officers observed the group displaying signs of nervousness. A subsequent search revealed the weapons concealed in their clothing and bags. According to the teenagers, they carried the weapons to rescue a friend who they claimed had been kidnapped and assaulted by unknown attackers. They asserted that the weapons were meant for self-defence during their rescue attempt. Despite their explanation, the police remained sceptical and detained them at the Dongtan substation. The parents of the detained teens were contacted and may face legal repercussions. Police Lieutenant and Deputy Investigation Chief of Mueng Chiang Mai Police Station Worawan Kanwana, along with investigation officers, yesterday arrested an 18 year old man nicknamed Bung Peach (pseudonym), along with two accomplices 17 year old Black, and a 14 year old Dao. They were found in possession of a samurai sword, motorcycles used in the crimes, and fruit juices and cigarettes robbed from victims. The incident began on May 11 when 20 year old Kangchit, and his 20 year old friend Thakdanai were skateboarding at Prasertsaran Land in Chiang Mai. A speeding car lost control and crashed into a furniture shop, narrowly missing the owner’s bedroom. The driver sustained minor injuries. At 7am today, July 30, a Honda Civic sedan with the registration number Ngor 9907 from Nakhon Ratchasima crashed into a furniture shop on Ha Yaek Road in the municipal area of Phanat Nikhom, Chonburi, causing significant damage. Police Lieutenant Colonel Teerachet Thichan from Phanat Nikhom Police Station arrived on the scene to investigate the incident. Upon arrival, the police discovered the car had ploughed through the shop, damaging various pieces of furniture, including cabinets, tables, and kitchen appliances. CCTV footage revealed the car speeding toward the shop before crashing into it, scattering items across the shop floor. The 57 year old shop owner, Orapin, recounted the event, stating it happened around 5am while she was resting in her bedroom. She was awoken by a loud crash and, upon investigation, found the car had smashed into her shop, hitting the concrete pillars and causing structural damage. “I heard a loud noise and came out to see the car inside my shop, breaking two concrete pillars and damaging the building’s structure” The driver, a woman estimated to be between 30 and 40 years old, suffered a minor head injury. She requested to be taken to the hospital for treatment. The extent of the damage to the shop has yet to be assessed, as Orapin intends to discuss compensation with the car owner and have the police serve as witnesses. “I’ve been running this shop for a long time, and this is the first time a car has crashed into it. Thankfully, no one was seriously hurt. I want to remind drivers to be careful, as this area is a busy intersection, especially during the day. If this had happened in the daytime, the damage and injuries could have been much worse.” Orapin expressed her concern, mentioning that she has been running the shop for many years and this is the first time such an accident has occurred. A father from Phrae province sought help from Sai Mai Must Survive after being scammed by a fake modelling agency that claimed his daughter would star in an advertisement alongside Lisa from BLACKPINK. He transferred money 42 times, totalling over 8.7 million baht. The victim recounted that earlier this year his wife got acquainted with a woman called Namphueng through Facebook. Namphueng presented herself as a talent scout for advertisements and TV dramas. Her convincing profile led the family to believe she could truly help their 11 year old daughter break into the entertainment industry. On May 16, he contacted Namphueng, who requested a payment of 17,000 baht for acting classes, promising future advertising gigs. After transferring the money, before the daughter even attended the classes, Namphueng invited her to an advertisement shoot for a famous brand of sour milk at a studio in Bang Yai, Nonthaburi, on May 25. Upon attending the shoot, the father observed a genuine production with other participants. Approximately one month later, he received a payment of 19,000 baht, reinforcing his trust in the scheme. Encouraged, he paid for additional acting classes for his 10 year old daughter. Namphueng continued to propose various advertisement opportunities, each time requiring a different amount for a security deposit, ranging from thousands to hundreds of thousands of baht. Convinced by the previous payment, the father continued to transfer money. On one occasion, Namphueng claimed she would arrange for the daughter to star in an advertisement alongside Lisa from BLACKPINK, promising a payment of 150,000 baht but requiring a 75,000 baht deposit. She even claimed to be close to Lisa, assuring the family they could all join the shoot. The fraud This promise led the family to travel from Phrae to Bangkok, where they checked into a hotel on July 11. Namphueng kept postponing, raising suspicion. Over time, the father realised he had been deceived, having transferred a total of 8.734 million baht, including borrowing over 2 million baht from relatives. Despite the fraud, Namphueng continued to post on Facebook seeking actors for advertisements. The father contacted Namphueng, who promised to return all the money by July 28 but has since been unreachable. Ekaphop Luangprasert, the founder of the Sai Mai Must Survive group, stated that they would assist the victim in filing a complaint with the police. He believes there are likely more victims. Namphueng’s Facebook page was still active as of July 26, continuing to recruit actors. Namphueng later called the victim, promising to start refunding some money on August 1 but did not guarantee full repayment. The director of the governments Budget Bureau yesterday confirmed the government can fund its 10,000-baht digital wallet scheme by using the fiscal year 2025 budget, provided it reallocates funds from canceled projects. An imprisoned Thai gambling king, Apirak “Sia Po” Chat-arnon, is seeking justice after a fellow inmate attempted to kill him inside Bang Kwang Central Prison near Bangkok. Lawyer Withun Keng-ngan disclosed the incident during an interview with Channel 3 on July 30. He and Sia Po’s family plan to take the case to the Ministry of Justice, fearing for Sia Po’s life in prison. Withun reported that the assassination attempt occurred earlier this year. Sia Po told his lawyer that an inmate tried to stab him with an iron rod, approximately 1.25 metres long. Thankfully, another inmate intervened, and Sia Po escaped unscathed. Sia Po believes that someone outside the prison orchestrated the attack and hired the perpetrator. Withun also noted unusual circumstances regarding the attacker, who had privileges uncommon among inmates, including possession of a storage room key that should be controlled by prison guards. The attacker claimed his motive was to gain respect from other inmates by killing Sia Po, though both Withun and Sia Po find this explanation questionable. Adding to their grievances, Withun cited concerns over unfair treatment within the prison. He claimed that Sia Po’s family is allowed to visit him only once a week, unlike other inmates who have daily visitations. Sia Po also felt mistreated after coughing up blood, which prison guards dismissed as a ploy using watermelon. Withun asserted that the blood was due to Sia Po’s heavy cigarette smoking before his incarceration. Having failed to contact the prison director, Withun plans to approach the Justice Ministry soon, accompanied by Sia Po’s family. Sia Po was arrested in 2022 and sentenced to over 50 years for gambling operations and money laundering. His sentence was reduced to 20 years, the maximum under Thai law. Thalang, Phuket – A motorbike rider from the Middle East found himself in hot water after performing daring wheelies in front of the Cherng Talay Police Station. On Monday, July 29th, at 3:45 P.M., CCTV footage captured the rider’s reckless antics at the intersection near the police station. The Traffic Police promptly gave chase and apprehended the rider, who was identified only as a “Middle Eastern motorbike rider.” The culprit was taken to the Cherng Talay Police Station to face charges related to reckless driving. They announced plans to submit their closing statement to the Constitutional Court by the end of the month. Somchai Swangkarn, a former Senator, revealed that the group is finalising a written closing statement for submission through the Senate speaker. According to Somchai, the statement will urge the court to hold the prime minister accountable for appointing an ineligible person to a ministerial position. Despite the Thai premier’s assertion that he sought the Council of State’s opinion on the matter, Somchai pointed out discrepancies in the request submitted by the Cabinet secretariat. The request did not ask the council for its opinion regarding the requirements for a Cabinet minister candidate under Section 160 (4) and (5) of the constitution, which demand that ministers uphold moral integrity and refrain from violating ethical standards for political office holders, said Somchai. “By asking if Pichit meets the requirement under Section 160 (6) and (7), the cabinet secretariat tried to create the narrative that Pichit was eligible to assume the post. “Had the Cabinet secretariat asked the council if Pichit meets the requirement under Section 160 (4) and (5), the answer would have been different.” Contempt of court The former senators filed the petition to remove the 62 year old Srettha as prime minister in May, arguing that Pichit was unfit for a Cabinet post due to his 2008 jail sentence for contempt of court, stemming from an attempt to bribe Supreme Court officials in a land case involving former Prime Minister Thaksin Shinawatra. Pichit resigned from his position as PM’s Office Minister just before the court accepted the petition, a move seen by observers as an effort to spare PM Srettha from legal complications. While the Constitutional Court agreed to hear the case against the Bangkok-born Srettha, it rejected the case against Pichit since he had already stepped down. The court is scheduled to deliver its ruling on the case against Srettha on August 14. A source in the Cabinet previously mentioned that Pichit’s imprisonment in 2008 did not disqualify him from being appointed as a Cabinet minister because he was appointed 10 years after completing his jail term, as required by election law. However, whether Pichit meets the moral and ethical standards mandated by the constitution is a separate issue, reported Bangkok Post. Former senator Wanchai Sornsiri also commented that Pichit was convicted only of contempt of court, not attempted bribery, which would have prevented him from assuming the ministerial post.
