  2. You can interpret whatever, in which ever manner you wish. No-one, especially not me, is arguing against certain incomes only being taxable in home Country. This is a fact. My contention, yet again, is that foreigners, who are Thai tax residents comply with the Revenue code. Section 40 TRD Black and white according to Thai Tax Law. Pensions are assessable income. By dint of an International Agreement some forms are pensions are not taxable in Thailand as they are only taxable in Home Countries. Just as some Pensions will not be subject to Thai tax, depending on tax already paid in Home Country.

The RD will work on the legalities of what is written in the tax code, what is written in DtA's / Visas / others is secondary. If, I repeat if, they come knocking at your door.

  19. Just read the above sentence again. Sure. DTA's will exempt certain incomes from Thai Taxation. What DTA's do not do. Is exempt you from complying with Thai Domestic Tax Policy / Law if you are a Thai Tax Resident. And we all know what the thresholds are for filing a tax return. I can fully accept that the term " Assessable income " is currently as clear as mud. A DTA does not state that XX income is considered " Non Assessable Income " under Thai Tax Law. They normally state only taxable in XX Country. Despite what happened for years and decades. The term " Only Taxable in XX Country " has never meant " Non Assessable " in Thailand.
  20. Your understanding is wrong ( IMO ) You are confusing 2 things. 1. Thai Domestic Tax Policy / Law 2. And International Bilateral Agreements ( DTA's ) To put it simply If you are a Thai Tax Resident, you are subject to Thai Domestic Tax Policy / Law. File as per the laid down threshold limits as laid down here. https://www.rd.go.th/fileadmin/download/english_form/2024/GUIDE_91_67_Complete.pdf An International Agreement ( DTA ) will exempt / limit you from thai Taxes under certain circumstances, dictated by Individual DTA's.

Why would they implement change, then try to make other changes, announced today, when they could just shut up and quietly drop it later, or even publicly, just come out and say the whole thing including Por 191 / 192 is cancelled ? It is because the driver is the OECD, and not Thailand. And the only way the can drop it / bin the whole thing is to withdraw from the tentacles of the OECD.
  22. Sure, I can accept the above. I can also see that global / worldwide taxation is being driven by the OECD. I don't believe that Thailand would be entertaining any of these tax changes, if it wasn't for the OECD.
