  1. It is being reported, in Thai media, that the transportation of chemical waste was halted on the second day, after resistance by local villagers, who blocked the vehicles. On day one, it is reported that 201 tons, of aluminium dross, were transported for disposal at a factory in Chonburi province. On the 19 May 9 trucks arrived to transport an additional 100 tons, to Mittlecom Co., Ltd. factory, Phanat Nikhom District, Chonburi, but local residents were refusing to allow it to be delivered and as a result, the transport of aluminium dross, from warehouse 3, has stopped. The Chonburi Governor is trying to explain to the locals, and clarify the situation.
  2. 20 May 2024, Rayong media reported a thank you to those involved, and from the statement it shows how many different agencies and departments worked together to suppress this fire. “Industrial Estate Authority of Thailand led by Governor Assoc. Prof. Dr. Weris Amrapal, along with SCG Chemicals, led by Mr. Mongkol Hengrojanasophon, Chief Operating Officer expressed there gratitude to all involved sectors, including government agencies, the private sector, and various local agencies who played an important role in helping to suppress the fire, which was a difficult and challenging mission. Those agencies included the Industrial Estate Authority of Thailand, Map Ta Phut Municipality, Rayong Provincial Disaster Prevention and Mitigation Office, Rayong Provincial Natural Resources and Environment Office, Pollution Control Department, Map Ta Phut Provincial Police Station and Chaloem Phrakiat Hospital, partner companies including NPC Safety and Environmental Services Company Limited, PTT LNG Company Limited, plus Rayong Rescue and Fire Departments and volunteers. Also the emergency response teams from the sites EMAG (Emergency Mutual Aid Group), which was established in 2000, and is a cooperative group of industrial plants, refineries and petrochemicals companies, who will help each other in the event of an emergency. Those member companies involved were, PTT Global Chemical Public Company Limited (PTTGC), IRPC Public Company Limited (IRPC), Co. Vestro (Thailand) Co., Ltd., Rayong Olefins Co., Ltd. (ROC), Map Ta Phut Olefins Co., Ltd. (MOC) and Thai Polyethylene Co., Ltd. (TPE). Assoc. Prof. Dr. Weris Amrapal, also said, IEAT, as the administrator of the Map Ta Phut Industrial Estate and Map Ta Phut Industrial Port, apologises for the incident, and there will be a full review to determination new joint guidelines for upgrading preventive measures to try to prevent further incidents, in terms of safety management and maintaining environmental quality, to help build confidence among all relevant stakeholders.”

Fully agree with all you say, but this company never had the permits to operate, so the safety measures, protections controls, systems of works, management systems, environmental measures, operating policies, documentation and records, you mentioned were never required, implemented or inspected. This factory is a total disaster, failing on any compliance, but seems for some reason, deliberate or not, to have been able to slip under the radar of all authorities. The following quotes are from the EARTH (Ecological Alert and Recovery-Thailand) press release in 2021, when Nong Phawa villagers finally sued the company demanding environmental restoration and compensation for agricultural losses. “ In 2013 provincial authorities ordered Win Process to cease operation and remove hazardous wastes from the area. The company ignored this order, and continued to transport and hold hazardous wastes without permits. However, regulatory agencies such as the Department of Industrial Works failed to investigate and punish the company.” “Tiab Smanmit, lost 1450 Rubber plants and 20 rai of arable land. We began to notice the impact since the establishment of the factory in 2010. It started with foul, unbearable smell coming from the factory.   7. Sorry all I can do is post credible links, with up to date information from liable sources. What I can not do is help you understand the facts and the truth. There were no prosecutions of either Boeing or individual employees, in 2021, because the administration pushed through the deferred prosecution deal, which stopped all potential charges, and as I keep saying all the information you need, is in that 2021 deal. It is no good to continue ranting about the MCAS and the two technical pilots, it is not going to change reality, or do you think if you post the same opinion over and over, it will somehow become the truth? I also noticed you did not answer my question, asking if you know who gave Boeing the 2021 deferred deal, is that because it does not fit you agenda?   8. Please link to those prosecution cases in Ethiopia and Indonesia. We will find out by July 7, if it is over, that will depend on what, who or if the Department of Justice decides to prosecute. If no action is taken then the 2021 deal will prevent any future prosecutions.

You posted the link to the Department of Justice, press release on the deferred prosecution deal, please try reading it again, it contains all the details of why Boeing or any of its employees were not prosecuted in 2021, what happens in the future will become clear in July, when the government may put safety before profit.   11. Try to stick to the reality, please post links to those countries that have filed any charges following the MAX 8 crashes. Even the lawyers for the families of the victims know this is not going to happen, hence they are meeting with the Department of Justice at the end of this month, to discuss the new filing for breeching the 2021 deal. Do you really think that extradition is going to be achieved when a deferred prosecution deal was secured, but don’t let reality and real fact get in the way.
  12. How could they have prosecuted those employees, when the government handed them immunity along with Boeing? Yes they should have been charged and that would have all come out if prosecutors had been allowed to charge Boeing with fraud. It was the out going administration, that stepped in and stoped the prosecutions, with the deferred deal, but fact, that may not fit the political agenda of many.

Your link and my picture above, clearly shows that the actions of Boeing and individuals employees was considered, but they all got immunity mandates, under the deferred prosecution deal. The real problem is not those individuals, but that deal, which came from an administration that oversaw a record reduction in overall corporate prosecutions and liked to use leniency deals allowing companies and executives to avoid sanctions, hence helping to further the profit before safety/regulation business approach. This Department of Justice new court filing claims, that Boeing has breached the 2021, differed prosecution deal by failing to “prevent and detect violations of the U.S. fraud laws throughout its operations.”, Boeing has until June 13 to formally respond to the allegation and the Justice Department says it will consider those comments then in determining whether to pursue any prosecution. At the court hearing, the Justice Department told the District Judge Reed O’Connor, that Boeing could be prosecuted for any crime the government knows about, but it did not give any details about what crimes it is considering. The Department of Justice told the judge that a final decision about Boeing and the deal, will be made no later than July 7. Until then the 2021 deal and the mandates and provisions remain in place, with the company and employees immune from those prosecutions.

As your earlier link above also shows, federal prosecutors have now said in new court filings, that Boeing had breached the 2021 immunity deal by failing to “prevent and detect violations of the U.S. fraud laws throughout its operations.”, but they did not offer any additional details on why they believed Boeing had breached the deal, and what or if possible prosecutions may follow. The deferred prosecution deal, which expired in January, included a six-month review period, which has allowed prosecutors to decide how the company has violated the original agreement. Boeing now has until June 13 to respond to the recent court filings. Remember the background, that in January 2021, federal prosecutors actually announced they were charging Boeing with one count of fraud for lying to federal regulators, but later the same day it was announced that Boeing and prosecutors had signed a deferred prosecution agreement, a deal brokered by the administration, that shielded Boeing from trial.That agreed deal required Boeing to pay out sanctions of $2.5 billion and to implement a corporate-compliance program to prevent future instances of fraud, among other mandates.
  16. Local government agencies have appointed a contract company for chemical waste disposal, and on 18 May they begun moving chemicals out the factory. Today they began transporting the aluminium dross waste from warehouse 3 and glass etching sludge from warehouse 2, this is prevent any further reactions/heating, leading to further fire outbreaks. The aluminium dross waste will be transported for disposal at the factory in Chonburi Province, 90 km away, while the glass etching sludge will be taken it for disposal at the cement factory, Kaeng Khoi District, Saraburi Province.

Update reported in Thai media. “17 May 2024 Map Ta Phut Industrial Port Office, The Regional Harbour Office 6 and the Rayong Provincial Natural Resources and Environment Office together with SCG Chemicals (SCGC) carried out water quality measurement in manholes around the site, which is mostly rainwater run off. The measurements were found to be within the standard expected criteria and having no impact on the environment. Water and foam, generated from firefighting, in the tank bund, is being pumped into tankers to transport and dispose of safely as required by law and there is no leakage into the sea and environment.”

The concern is why they were granted the deferred prosecution agreement in the first place, was it just pure protectionism, as the government agreed not to prosecute Boeing on a charge of defrauding the United States by deceiving regulators about the flight system and allowed them to escape their full responsibility, limited the compensation they were liable for and helped the lowering of safety standards, regulations and oversight. U.S. Senator Richard Blumenthal, Chair of the Senate Permanent Subcommittee on Investigations, released the following statement after the Department of Justice filed a letter in federal court asserting that Boeing has violated the terms of a deferred prosecution agreement. “When Boeing was granted a deferred prosecution agreement, I said that it would incentivise bad behaviour and do nothing to change the rotten corporate culture that allowed Boeing to mislead and deceive regulators, because it held no one accountable. The only way to ensure companies put safety above profit is through transparency and accountability.”
  19. Yes fully agree. I have never been in this complex, but looking at the picture you posted yesterday, I would image no sprinklers and maybe only heat detectors in rooms and smoke detectors in corridors. The fire safety measures did work during this incident, the fire was basically contained in the unit of origin, the alarm was raised and everyone was able to safely evacuate. Yes there was smoke in the corridors and a bit of external smoke/heat scorching, but the damage was mainly to one unit and no reported injuries. It should also be noted that fire sprinklers main purpose is to contain a fire, not extinguish it, but if a fire is fully extinguished by the sprinklers that is a bonus. Sprinklers also raise the alarm, as they act as a heat detector and by containing a fire and stopping any spread, it allows a safer evacuation, with people having more time to exit. Even with a sprinkler controlled fire you are still going to get smoke, and it depends on the quality of doors (rarely see smoke seals on doors in Thailand) or if the door is closed, as to how much smoke gets into the corridor, also remember the emergency responders will have to open doors and it then stays open to allow hose lines into the unit, with applying water onto a fire initially producing steam and more smoke. Also sprinklers are not like in the movie, a sprinkler head requires direct heat to operate, (a sprinkler with red liquid is designed to operate at 68C) and only that sprinkler head allows water to flow, not all of them on the system.

Read the police reports, the autopsy and inquest reports, what the hotel staff said, the note he left, his medical history of PTSD, the CCTV at the hotel and the fact his whistleblower days ended with his last testimony, years ago. This court case was about his AIR21 claim, which even OHSA had dismissed, saying there was no evidence. His days of posing any problem to Boeing had past, and he had nothing new to add.
