    It can run an air con too, so payback is about 6 to 7 years. 

     

    Its a new build and located about 1 kilometer from the PEA grid, to connect to the PEA I would have needed a transformer, posts and cabling, that would have cost approx double the cost of the solar.  Plus where I live the electric is off and on all the time.  So far I'm quite happy with it.

  2. I used the money to install an off-grid solar system ( DIY ) instead of paying to connect to PEA.

     

    It cost approx 150,000 baht runs the fridge, shower, tv's, computers fans etc. it can run 1 air air con.   If I want more air cons say to run 3 air con, then I would need to add another inverter and battery at a further cost of 70,000 baht.

    How are you getting power? Can the fibre not use those poles?

     

    You certainly shouldn't have strung fibre without the permission of the owner be it the neighbour or PEA (the internet company likely have a blanket permission from PEA). What have the police said, if anything?

     

    And I agree, 100k to use the poles does seem excessive.

     

    I installed off-grid solar for electric and intend to extend this as required, the electric here up and down all the time.

     

    The poles are before my neighbours meter, but after their transformer.  The poles are of the the smaller size and run across private land that is not my neighbours.

     

    I bought some blue pvc pipe to house the fibre cable, my intention was to use this initially, however after hearing the same from several different people, that the poles become available for public use after 6 months, I decided to use the poles.

     

    So now, as my neighbour has contacted the police, we are being asked to take down the fibre, I would like to clarify if the poles are available for public use or not and would like advice on how I can establish this ?

     

    In the UK I would contact Enviromental Planning department.  In Thailand is it the Or Bor Tor Office... which government office would control the use of utility poles ?

  4. About 10 years ago, my neighbour installed utility poles, spanning approx 300 meters across privately owned land ( not his land ).

     

    I have come to install fibre internet across these poles, my neighbour has requested that I pay them 100,000 baht to use these poles ( he installed 10 years prior ).

     

    Several people local to the village commented that I should not need to pay to use the poles, as they have been there for more than 6 months.  I.e. villagers claim that utility poles that are privately installed, become available for public use after 6 months, if I wanted to use them in the first 6 months I should pay, but after 6 months there is no need to pay as they automatically become available for public use.

     

    The fibre has now been installed across the poles, my neighbour has been to the police and is requesting I that the internet line be removed from the poles or I must pay 100,000 baht.

     

    I would like verify the availability of these poles for public use and would welcome any advise on how I can go about this.

     

     

  5. I'm sourcing a supplier for windows and doors.  Full height 2.5, various runs from 2 fixed / 4 sliding units approx 1.8m in length.

     

    Given doors and windows will be in the shade, will single glazed do, double glazed an overkill ?  They living style will be open during the day, open at night with mosquito screens.  Property is on the sound of a mountain with good cross wind.  The aircons may run for 1 or 2 hours early evening to cool down the rooms ( if necessay )  hence my consideration for not going to the additional expense of double glazing.

     

    Given the units are full height 2.5m standard size units cannot be used. looking for recommendations for windows / doors of low price.  

     

    Given standard size units are approx 3,000 baht sqm and custom units I've seen so far 6,000 baht sqm.  So I'm looking for recommendation to fit custom windows as near to the standard unit price as possible.  Is it really necessary to stay with the custom units provider at 6,000 baht sqm.

  6. For ownership to be transferred, the Land Department must amend the land title(s) to reflect the position of the new border(s)... I understand that this is done by a judge via court order, therefore the individual trying to take the land must satify the judge that all necessary criteria have met.

     

    As the person who stands to benefit is in most cases the individual trying to take over the land, therefore it is with them to pay the court fees to have the land title papers amended.

     

    Aside from the judge requesting the land office to change the borders, the rest are my assumptions.

    Section 1382. Where a person has, for an uninterrupted period of ten years in case of an immovable, or five years in case of a movable, peacefully and openly possessed a property belonging to another, with the intention to be its owner, he acquires the ownership of it.

     

    Does this mean, one can simply maintain a fence around a parcel of land for 10 years, to take ownership of it...  Must one update the land office at any point ?

  8. In the UK Your company may qualify for an audit exemption if it has an annual turnover of no more £10.2 million or assets worth no more than £5.1 million. 

     

    Basically this means you don't need an accountant, you can do the book keeping, prepare and submit the annual financial statements ( balance sheet & profit and loss ) yourself.

     

    Is there no such audit exemption in Thailand for Ltd Cos ?

     

    At least I would like to do the book keeping myself.

    GF want my son ( the son I have with her he is 5 years old ) and my daughter on the title deed.

     

    The is not my first choice... I intend to maintain the choice of using the Thai accommodation business as security to purchase a boat, so that funds from my UK accommodation business can be used to fund the growth of the Thai accommodation business.  If I put my son on the title deed it means I need to wait 13 years until they are both ( my son and daughter ) are over the ago of 18 years, instead of just 7 years if it were only my daughter.

     

    Her reasoning for this is that she wants to look out for my sons future...  so after 1 day of contemplation, I conceeded, and agreed to putting both my son and daughter on the title deed.... so long as GF did the same with her land, i.e. transfer her land into my sons name.  Initially she agreed, a day later, she refused, spouting why do I try to control her... bla bla bla.

     

    This is a business I am running, I can't have GF meddling in business affairs, each time we have a fall out, its not practical, and her interference blocks progress.  I am not able to go to the land office to upgrade land to chanote, order land survey etc etc... 

     

    All 4 of my children each will get 25% my estate, which will be stipulated in my will, and drawn up by my soilicitor / lawyer.

    Regards the law being in effective, I hope that is not the case, without the legal system as a viable means to reconcile wrong doings, we as a human race decend into bunch of savages, seeking recompense for wrong doings via our own means, God forbid.

    It is a criminal offence for a Thai national to purchase land in Thailand, in place of a foreigner.  When funds to purchase land in Thailand are coming from a foreigner,  a procedure must be followed, at the land office to declare said funds as the personal property of the Thai national.  If this is not done the following criminal and offences are committed.   

     

    Criminal offences comitted

    1. Thai national : violation of Criminal Code Section 267
    2. Thai national : violation of Section 94 / 96 of the Land Code
    3. Foreigner : violation of  Section 94 / 96 of the Land Code 

     

    Also, the foreigner has rights to refund of their personal property, based on the 'undue enrichment' sections of the civil code.

    Whilst in this case, I unknowingly did commit a criminal offence when girl friend recommended, and did purchase land in her name with my peronal property, as stated by her to get a building license, and then later she will transfer to daughters naem.  Both girl firend and myself must serve whatever sentance is handed down by the court. 

     

    When girl friend unduely enriches herself by taking the my personal property.  I should also consider the consequences of standing idly by and do nothing, is thus sending girl friend the wrong message, she can unduely enrich herself by taking my property as her personal property whilst suffering no consequence.

    I do not for a minute believe that you would be sentenced to imprisonment. If everything is made clear to the court that the purchase was for your daughter and her future and that you girlfriend deliberately mislead you, resulting in misappropriation of property, the court is more likely to side with you. At worst a fine but I do not believe the land will be taken from you. More likely your ex-girlfriend will be bound to transfer the land to your daughter as originally intended. 

     

    However, what you do need to look into is whether a fine or any kind of ruling against you would have an impact in getting visas for Thailand for yourself. 

     

    My sentiment also.
