From the royal gazette DTV ข้อ ๓ คนต่างด้าวซึ่งมีประสงค์จะขออนุญาตเข้ามาอยู่ในราชอาณาจักร เป็นกรณีพิเศษตามประกาศนี้ ให้ยื่นคำขอตรวจลงตราประเภทนักท่องเที่ยว ประเภทพิเศษ (Destination Thailand Visa : DTV) โดยสามารถยื่นขอรับการตรวจลงตราได้จากสถานเอกอัครราชทูตหรือสถานกงสุลใหญ่ของไทยในต่างประเทศ สำหรับปีนี้ใช้ได้จำกัดจำนวนครั้ง ภายในอายุการใช้ตามการตรวจลงตรานี้ Article 3: Foreigners who wish to apply for permission to stay in the Kingdom as a special case according to this announcement must apply for a special tourist visa (Destination Thailand Visa: DTV). The application for the visa can be made at Thai embassies or consulates abroad. The visa can be used for an unlimited number of times within the validity period of the visa.

I dont hold one.. I just got a DTV but will probably move to LTR. The question was online work rights on the wealthy global or global pensioner classes and the BOI helpdesk, and the BOI video call lawyer oth repeatdly assured me it was fine.. But as said above kind of backtracked a bit when challenged on legality.

Oh I have.. Its a saga.. They said its legal.. I went to labour office they said it wasnt.. I asked again they said yes its legal.. I had a video call with them, explained that the labour dept dissagreed with him, and can he show me the law.. He then started to say 'well theres no tax so its ok'.. No that isnt the same thing.. 'Well we have talked to the revenue dept and we have an understanding'... I explained the elite folks made the same claims and in the end turned out to be wrong and reversed it, if it is legal it must say so in law somewhere and that 'an understanding' isnt the same as legal.. Ended up with him just saying things like 'you wont get in trouble' etc but having no law he could show. Made me suspect of everything else he said really.

Right.. And going through them both english and with chatgpt translating and also searching and summarising.. I can not see where they include the right to work online without a work permit. The DTV notification actually says it as a right 'under this special circumstance'. The work from Thailand one is an entire class, it has no logic that it doesnt give that right and yet they only talk about tax rates and I do not see it addressed. Especially applicable to the wealthy pensioner and wealthy global citizen where the BOI claim it as 'tolerated' and justify it as 'not being taxable' but I dont see this in the law ? Anyone can show where it is exempted, allowed or otherwise said.

If you are saying it is a poorly enforced law.. Fully agreed. I have never stated otherwise. It is the claim that it is not illegal, or that no one has ever been punished for it, that I am saying is factually wrong. It IS illegal, as is evidenced by the people arrested and deportated, by the my mate nate saga and clarifications, by MANY statements fromt he labour dept and immigration, by the chinese vlogger etc. It is precisely due to it being illegal that people 'need to be descrete about it' etc. If it was legal why is there any need to hide it ? Yes, laws in Thailand are frequently pooly enforced, theres no prostitutes in pattaya and all nightlife closes at midnight.. That fact doesnt change the law.

Maybe you would but you can see why many would rather border hop than pay 10k. I travel each year, but I dont always travel each 6 months, I will see how they handle this.

Chiang mai locator, or even a candid interview with the labour office about enforcement has zero relevance to the actual law. If your saying 'be descrete' you are admitting you need to hide, if you need to hide then why ?? Because it isnt legal thats why. If something is legal you are fully allowed to do it, you have no need to 'be descrete' !! FACT People have been arrested and deported for working 100% online. FACT That is because working online requires a work permit, a work permit exemption, or to be on one of the visa classes which carries the right to do so. REALITY It, like almost every law in the country, is sloppily enforced. This one also has economic and bad press implications and one Thailand doesnt push hard on unless they want to use it as a reason.

Depends on if it is 1900 or 10,000 THB.. The cabinet meeting says 10k for the extension, the royal gazette doesnt.

You are moving the goalposts.. What I told them to retract and never claim again was "There's no history of deportations of online workers here" which is factually a lie. There IS history of it, this one, the Chinese vlogger etc.. Maybe they are fringe cases, maybe they upset someone, but it clearly proves what the law is because if it was not illegal, it could not have been used against them to deport them when they wished to do so.

What does it matter what visa he was son, you claimed you can work online on any visa and that no one has ever been punished for it.. I know of 2 other cases from Phuket days also but no media as they were just arrested and gone. What does it matter what his neighbour said.. He was arrested and deported for working online... The same as the Chinese vlogger was who embarassed them.
