Can my g/f go this route I hold British + Irish passports and my g/f is the mother of our daughter who holds British + Thai passports.
Need a UK visitor visa for the g/f and if this route is easier than all the hassle at the British embassy then I would prefer the easier option.

Can't you just have something stated in the running of the company that after your gone that the shares are transfered to a member of your family or am I missing something
I might be missing something! I'll look into that as well.
Hi Johnny, Let us know if that is possible.

Just put your name down when you initially start the company up, you'll be surprised that you may not have any problems and do not have to wait the 3 months.
If you do have any issues then as a last resort do it your way!

When I bought my land and built my house in my company's name I was issued with a blue book (Tabian Bahn) showing my company as the 'owner' of the house.
Could you have been the 'owner of the house' without the company owning it and have you own the house only in your name with the company giving you rights to build the house?
If the above case is acceptable could you wife then obtain the blue book?
-
if your finished price is with %20 of what he told you to start then consider yourself lucky.
I have never ever heard of anybody in LOS getting a house finished for what the builder originally quoted.
but besides this, it seems he thinks you a good mark and is going to be a bully on this one.
best way to fight a thai bully is by being so dumb that you are dumber than the dumbest falang and then they will get frustrated because they think you are even too stupid to fall for their stupid tricks.
you have to be sooo dumb that even your wife will think that you have gone stupid.
and remember to have a nice smile being dumb
if you are stupid enough then he will self implode and retreat in shame.
much more effective than direct confrontation.
The guy i'm dealing with is falang but working for a thai construction company........
That says it all, especially in Samui!

3a. concerning tee-money, you give the envelope after you have your building permit, or before ?
Who told you this?
Is it golf money for someone?

When my wife has travelled alone with our kid she has not had any problems either leaving our resident country or entering her home country (or vice versa) as both of them are travelling with the same nationality passport.
I on the other hand have twice been questioned by immigration in her home country when entering with our child as we both have different national passports. It was not a problem though as the wife was in a different queue.
When we have gone to UK child and I go through immigration together no problem while wife queues with the hundreds of others on a visa, there's no special dispensation for foreigner travelling with a national.
Actually, I think you'll find that you can go through passport control together as a family. If you don't want to try going through the UK and EU lane, you could go through the other passports lane with her.
Anyone confirm this; that you can all go through the UK channel and they will deal with your thai g/f-wife who is on a visa without sending her back into the 10 mile long queue?
I doubt you could do it with your girlfriend who is on a short term visit visa, you'd have to go through the other passport lane with her, but if you are a family unit, they should let you through the UK/EU passport queue.
Are we defining the family unit as being married? I would have thought if you have a child with your g/f then you are still a family unit.
Long queues in the UK chanel I have experienced but they clear quickly. The non uk/eu channel seems to be massive everytime I land and I doubt clearance is that quick. Saying that BKK entry queues have bee ridiculous the past 2 times I've landed!

Maybe nearly there.
1. The building permit needs to be in my name
2. Proof that I purchased the materials (Documents From the bank + building material receipts) - Not 100% Sure about this.
3. Chanote needs to have my name on the back (Can possibly have multiple names)
The above will prove that I legally own the house!
This will allow me to get a Yellow Tabian bahn that gives me proof of where I live in Thailand.
Do I just sign something that will then give my partner (thai) and our daughter rights to have a blue tabian bahn book?
Many Thanks

Declare on the swift form what the money is being sent for. Should not be any problems if you do this
The thai lawyers told me to put the reason for transfer as 'Investment In Thailand'
-
The owner of the land must agree to put the farang's name on the Chanote as owner of the house. This is normally done BEFORE the house is built; along with a lease, usufruct, etc.
That's fantastic thanks 'LoveDaBlues'
So this would probably entail a trip to the land department to authorise this and a copy of the chanote so you have some evidence as a hard copy.
Ok then can more than 1 person be put on the chanote for joint ownership?
I don't know why multiple persons can't be shown as owners. Are you building a house or buying an existing house?
Building a house. Ideally I would like my name alone as the owner but the g/f to get the blue book. But am prepared to go 50/50 if it means she can get the blue tabian book. Don't want to go 100% g/f and loose complete control.

Only one document truly shows that you own the Freehold interest in the land and that is the title deed, here that is known as the Chanode, which is off limits to you seeing as you are a foreigner.
The other books mentioned above merely show that you are resident at this address or are the head of the house. Useful but they do not constitute ownership in and of themselves because they do not show that you own the Fee Simple Absolute in Possession (google it), only the Chanode does that.
God the question does not want to know about the land as is clearly stated, I want to know about the bloody house! Screeeeeeeeeeeeeaaaaaaaaaaaaaaammmmmmmmmmmm.
Not in LOS at the moment or I would at this point go and talk to a lawyer. But I just cannot believe no one knows.
-
I find this unbelievable as so many falangs talk about putting the house in their name that no one can give a positive answer to what constitutes them legally owning that house that they bought.
Bumped!

i too build my house with "Superblock" but not in my wildest dreams i would have used 7.5cm for any outside wall because of the minimised insulation factor.
What thickness blocks did you choose for the outside walls Naam?
-
Pounds dropping again as we speak!
-
I note you say you used double Q Con blocks. Does this mean two separate layers of Q con blocks with a gap in the middle. If so does that make a large difference over 1 layer, bearing in mind the heat resistance of Q Con blocks is 6 times less approx. compared to red brick.
Regards
Dave
Did you do cavity with the blocks and if so did you just leave the cavity empty with ties or no ties and empty?
-
The house has a 60 to 1 mtr crawl space underneath with air blocks on every wall to get a through draft. The floor stays cold.
Does this not encourage problems with animals etc?
-
Normally the person whose name is on the Chanot or other land title deed will also be the owner of whatever is built on the land. Yes somebody (also a foreigner) can own a house without owning the land it has been built on. I figure in that case this has to be written on the Chanot or other land paper.
It's not a question designed for you to have a guess at!
Thank You.

Ok so now I am maybe one step closer to solving this but have been confused by IssanLawyers, who you would have thought could give you a correct legal answer.
1. The building permit needs to be in my name (Document)
2. I have to show proof that I purchased the materials (Documents From the bank + building material receipts)
Anymore confirmations to prove that these are the documents that I need to prove legal ownership of a building?
If this is true then the tabian bahn is not required!
-
but!. The yellow book in itself is not a proof of ownership, it is a proof of your address.
I think it is the building permit that proofs that. Or some other document.
This is the issue my original post refers to. What is the legal document that says you own the house?
-
So for a foreigner you need to get a "Ta bian ban" is that correct to be the legal owner of a house?
