fvw53 Posted September 30, 2018 Share Posted September 30, 2018 the Thai Condo Act of 2008 stipulates that manager of the Juristic Person shall : (6) to take legal action against co-owners who has overdue payment exceeding 6 months; It seems those co-owners loose their voting rights in the General Assembly of the Co-Owners : can somebody indicate which paragraph of the Condo Act stipulates this? For example in my building the JPM can cut off power water telephone. meinphuket Posted October 1, 2018 Share Posted October 1, 2018 After 6 months of non payment, owners lose their rights to common area services, as well as voting rights. This applies not only to both committee voting, AGMs and EGMs. This is clearly stated in the condominium act, and needs not be written in the rules and regulations because the law always overrides the former. After monthly written, registered reminders for payment without compliance, it is within the brief of the Juristic Person to file a court request to have the unit (s) auctioned off after a period of 6 months, unless the committee advises otherwise. The JPM -he/she manages the building on a daily basis-not the committee Typically the JPM will seek consent from the committee. He can still act even if the committee says'NO!' As MEINPUCKET states the JPM can sell the condo at auction. This will involve 3 visits to the local court. The judge will give the co -owner pleny of time to correct the circumstance. If it is sold the proceeds from the sale go to the JPM He can legally extract every ounce of cost that the building has occurred. The balance goes to the now ex-co-owner. This becomes very difficult if a farang co -owner,who has not left a Thai will ,has died in his/her own country . The hearsay timescale for the sale of this condo is 10 years.
