Employer is deducting taxes but provides no documentation.

I have a work permit and have been working for some time.

 

My employer is deducting/withholding taxes from my base salary and provides me with absolutely nothing in terms of documentation. My requests for documentation, pay-slips etc. meet with obfuscation and delays. 

 

My question is: What is the minimum documentation that employers are legally required to provide employees with regards to salary deductions and taxes? I'm looking for the relevant Thai legal code sections § etc.

You should recieve a PND 91 each year, I think about March time although not sure. Have they provided you with your social security card and tax number yet. My last employer didnt pay either mine for a year and I was oblivious to it.

They must give you a pay slip

My employer has provided me with absolutely nothing. I have been to the revenue department and they are willing to help me but my employer has not yet been able to issue me even one single pay-slip for 2560/61 BE. I am entitled to a full refund of all taxes withheld by my employer. I'm now googling "PND 91" Thanks for that.

 

If anyone has the The Thai legal code and relevant sections regarding an employer's responsibilities in this respect post a link. Please. That's what I'm looking for.

Agree, they have a solid reputation for listening and acting regardless of nationality.

 

If your in BKK, go to the major Dept of Labour tower in Din Daeng, as you approach that building you can see (ground floor) a very big sign (Thai and English) indication '...... office for grievances'.

 

A farang friend went there a couple of years back with a Thai friend.  A young Thai officer immediately came over and shook hands and in perfect English said, 'Good morning gentlemen, how can I help you'. He sat them down, asked another colleagues to quickly join the discussion and take notes (she spoke good English also). He asked politely asked if the farangs' Thai friend spoke English, she did.

 

The officer listened carefully, asked some good relevant questions, then quickly produced some handouts, all in English about relevant Thai laws and regulations, then said, please try one more time, gave the farang some handouts about relevant regulations and said I suggest you take this approach...and if your not satisfied come back quickly. And he gave both visitors his official name card.

 

My farang friend did try again with no result whatever, he went back to the same officer who then started a quick action to visit the employer (with the farang) and to ask why the employer had not followed the appropriate laws.

 

The officer had the power to and did issue a 50,000Baht fine on the spot and asked for immediate payment. Also said if fine not paid in 7 days 30 days jail for company owner.

 

The employer changed his attitude quickly and made several apologies.

 

The labour officer asked the farang 'do you want to continue working her?' Farang said 'NO'. Officer then issued another document to both parties that the farang had to be paid serious compensation for the loss of employment. 

 

Over many decades I've heard many other good reports about this office.

 

 

If you work for a government university / (probably school too ??), i mean directly employed by them not with agency, you didn't receive any papers, salary slip, except the yearly PND 91. It's have been like that more than 30 years.

That isn't a reason for the situation to continue.

Have they, or are they going to file your tax return on your behalf for last year before 31 April ?

Maybe you are too old / techie phobic to know that you can get your payslips online at your govt uni website...
