Here are my vitals:

32 years old, married to a Thai woman.

I am currently on one year non immigrant type-o visa.

I have a job lined up, and should be receiving a work permit through them.

I am taking a flight back to the US, and will be returning the same day my visa expires.

My employee said they will give me some documents to show that I have an employer here in

thailand.

My wife and I will be making more than 40k baht/month.

I have more than 400K baht in a bank account.

I want to return back to thailand and stay indefinitely.

What should I do?

TYVM in advance.

Get a 90 day visa at the Embassy/Consulate in the USA based on being married or being sponsored by a employer. When you arrive back in Thailand apply for the work permit. With one month remaining on your 90 day visa, apply for the extension of stay based on marriage. You will need a letter from your employer and copies of the PND #1 (monthly withholding tax) You will need as well these documents…

1.Copy of Household Registration of Thai Wife.

2. Copy of Identification Card of Thai Wife.

3. Copy of Marriage Certificate

4. Statement of guarantee of pension income from your Embassy that you have an income of at least Baht 40,000 per month or letter of guarantee from a foreign employer, that you are a employee, salary, position, years worked or proof of this Thai income by you or your wife with the last months of Phor Ngor Dor.1 (Personal Income tax form filed on a monthly basis) and Phor Ngor Dor.91 ( Filed on a yearly basis in March)

5.Copy of birth certificates of children. (if any)

6.Photo of place of residence. (show house’s number)

7.Map and telephone’s number of place of residence.

8.If working, a letter of guarantee from your employer. A copy of work permit as well if working in Thailand.

9. Photos of your wife clothes and your clothes in the same closet, picture of your wife and you sitting on a living room sofa and pictures of the wedding. (This is not required if you have a birth certificate of children together.)

10. Application form TM 7 with 2x2 inch square photo’s attached.

11. A valid passport

12.If married overseas, the marriage certificate must be certified at the local Embassy of the country where the marriage took place, and it must be translated and certified by the Ministry of Foreign Affairs. This must then by certified by the District Office where the Thai spouse has their household registration.

I don't know about the wife but it would appear that he will not qualify if he requires three months of tax records to support his 40k income. He might want to obtain a multi entry O visa if he can and really wants to use the marriage extension of stay. Or I suspect he could use employment extension of stay for the interim and then change to marriage later?

As long as Immigration sees he just got the work permit, they are ok even with one month PND #1, for the applicant to get the extension of stay based on marriage. (Please note this is Bangkok Immigration)

The extension of stay based on business may be an option but is much more difficult for most employers and his salary would have to be increased to 50K per month.

The other option is to ask for a multi entry "O" or "B" visa and then he does a visa run till he has three months PND #1. As stated however he should be ok with just one month PND #1 before he applies for the extension of stay.
