Marriage "O" Visa

What are the current requirements to get a Marriage "O" Visa? I see different info on different websites. Some say you need 400k in the bank for 2 months or 3 months before applying for it. And also need it 2 or 3 months before applying for yearly extensions. Some say you need to have it in a Thai bank account and the funds MUST be proven to come from overseas. Others don't say anything about this. Another says if you are applying at the local Thai embassy in your country they may now require you to show at least 100,000THB in a Thai bank account. Also if doing overseas then everything in Thai must be translated into English.

 

Can someone explain the exact requirements and can it be done in Thailand or the home country embassy/consulate? (Australia in my case). Can it also be done inside Thailand while on a METV? One website said the 1st time you do the visa it must be done from your home country. Is this true?

 

I also saw "If you are a foreign lady married to a Thai man then there is no financial requirement for your extension of stay." Is this true? If so, why the double standard between a man and a woman?

There is always confusion between applying for a non-o visa at a embassy or consulate and a one year extension of stay based upon marriage applied for at immigration due to people calling both of them a non-o visa or even a marriage visa.

You can apply for a multiple entry non-o visa that allows unlimited 90 day entries for a year from the date of issue at the consulates in Savannakhet, Laos or Ho Chi Minh City, Vietnam without any financial proof. Or in Australia at the embassy in Canberra or the official consulate in Sydney.

To apply for a one year extension of stay at immigration you need 400k baht in a Thai bank for 2 months in your name only or proof of 40k baht income.

You can apply for a change of visa status from a tourist visa to a 90 day non immigrant visa (category O) entry at a immigration office based upon qualifying for an extension of stay based upon marriage.

There is certainly no requirement to get the first non-o visa in your home country.

If you’re looking to live in Thailand it’s a two stage process. First you need a Non-immigrant ‘O visa to enter the country, then — after 90 days — you need to extend your stay.

 

When applying for Non-immigrant ‘O visa in Australia you don’t need to provide any financials if applying at the Thai embassy in Canberra.

 

When applying for a 1 year extension of stay (immigration office) after you’ve entered Thailand you need 400K in a Thai bank account for 2 months prior to the application day. They shouldn’t ask for proof the funds came from abroad.

 

Yes, a foreign women doesn’t need to provide financials, her husband does.

Does the 400k in a Thai bank need proof that it was transferred from overseas, or can you just use existing funds in the Thai bank account if it's already in there?

For the Non-O It says the below. How is it possible for a Thai husband or wife to have "A copy of the visa or work permit of a spouse or parent who is currently working in Thailand"? They are already Thai so they don't need something like that...

  • A proof of relationships such as marriage certificate or birth certificate.
  • A confirmation letter from your spouse or family member with their Thai ID card and house registration.
  • A copy of the visa or work permit of a spouse or parent who is currently working in Thailand

Existing funds should be accepted.

You can ignore that requirement it doesn’t apply to you. That is for a foreigner that is related to another foreigner working in Thailand.

 

You just need to provide the first two; proof of marriage and you wife’s ID and Tabian Baan (house registration).

The is no requirement to prove the 400 baht came from abroad to apply for a visa or extension of stay based upon marriage at immigration.

 

The last line in the requirements is for the spouse of  a person working here not if you are married to a Thai.
