My friend is currently married according to Dutch law to a Thai.

He is never mentioned in his house registration book in Thailand and never signed a paper in his life let alone for the houseregistration in Thailand

His marriage visa is based on a never legalized marriage paper from the netherlands and then presented to the amphur for registration.

Under the table they issued her a korror3 document and of she went to get him a thai marriage visa.

after heavily investing in thailand he became suspicious about her intentions(to put it mildly) a bit late but in the mean time he wants to get rid of his marriagevisa( still valid) and change to a non 0 retirementvisa.

he cant divorce in Thailand since he according to Thai law is neven properly regognized as married.

His marriage visa is based on .........what?

Whats the best thing he can do ??????

Legally married is just that, no matter where the deed was done. :o

I do not understand the bit about the Amphur, and his wife getting him a visa.

That all sounds very dodgy.

However he can easily do a visa run, and apply for a new Non Imm O based on the wish to retire.

This will invalidate his previous visa and he starts again.

At the end of the 3 months he can apply for a one year extension based on retirement (I assume he is over 50).

Provided he meets the financial requirements he should have no problem.

If he tries to do this without letting the wife know he may have a problem. Immigration is very keen to let spouse know if there is a change in visa extension status and if done directly it would surly involve wife signing papers in person that she understands. Going outside to obtain a new non immigrant visa may or may not change that requirement; as it will be very obvious he previously held such a visa extension of stay.

Thats the point.

he wants to divorce.....but can only divorce in Nl.

The problem here is that his wife got him a marriage visa in the first place with the """Help""" of her brother of "knowed" somebody at the Amphur.

Aldo the marriagelicence had been translated...it never could get trough Foreign affairs in Thailand because it never have been going treu the legalization chain in both countrys.

To my understanding and experience with Mofa Thailand there are no "inside-outside transactions possible.

So in fact

the KorRor 3 paper needed toget a marriagevisa is illigally obtained by his wife.

Then there the question of signing the housingpapers.

Aldo he is?? (not) legally married in thailand, she could sign the housingpapers on her own without his precense and without his signature, illigally obtained according to Thai law as I understand it( husband must be present and is request to sign too.

So there we have the problem.

a thai lawey has no jurisdiction on this matter of divorce because there is nothing to be divorced from in Thailand.

In the mean time, he .....speaks almost no English...let alone any Thai is handed over to ////yeah whom.??

I see no options to, without getting his wife involved......to change his visa (here in thailand)

I got the impression that they were very keen in protecting Thai intrests.

He will lose as much as 10 mil bath in this matter.

I strongly urge a Thai lawyer who communicates well in the language your friend speaks and hopefully has some experience in domestic relations and immigration matters.

If his status is illegal and he had nothing to do with making it that way, I suspect his lawyer could straighten it out without much difficulty.
