Scottish court rules that PM Johnson's decision to suspend parliament is lawful

LONDON (Reuters) - British Prime Minister Boris Johnson’s decision to suspend parliament later this month until mid-October is lawful, a Scottish court ruled on Wednesday.

More than 75 lawmakers had legally challenged Johnson’s right to suspend, or prorogue parliament, arguing it was illegal and unconstitutional because he was seeking to do so in order to force through a no-deal Brexit on Oct. 31 by limiting the opportunity for opponents to object.

Judge Raymond Doherty said the question was not a matter for the courts and was a political issue.

A rare sensible decision by a judge. Keep the judiciary and executive separate.

When the executive goes rogue, how do we control it?

Not that important but thanks anyway.

That's parliaments job. The executive is and must be accountable to parliament and not above the law.

Interesting. Haven't received the commentary of this from the UK Constitutional Law Association.

This judge must deliver his verdict in accordance with his interpretation. I thought this will go to the Appellant and Supreme courts. We shall see.

The UKCLA were mainly of the opinion any suspension deemed to be deliberately aimed at preventing parliamentary debate on a crucial critical issue would be deemed illegal.

That's where we normally have a parliament for, being the legislative body and the one, whio controls the government. But in the UK, the gov. decides, when any discussion, voting etc is, when sent home , and even for an election: get 2/3 together and.. next week again an GE, where the candidate in one of the 650 obscure baronies,. with just one vote more that the others, get the seat, and the others… nothing. 50% + 1 = government with nearly dictatorial powers.

Only the HoL = appointed, but complaining,. in the Union of States, gov emoployees are appointed ( the representative of the UK in.. FIFA, UN, WHO, Bank of England... are elected ?

British democracy.
