I have nothing to prove to you. I just gather evidence that eventualy, God forbid if the worst comes to worse I can show that the death of an innocent child was not an accident but sheer criminal negligence.

It looks like OMIB wants a child hurt or worse, just so he can say "I told you so" to be the big man and be right for once.

Mike, there is a group in Thailand called The Lighthouse Club, who look after the welfare of under privaliged construction workers children. They are having a meeting in Flannagans Bar (Not far for you) on Friday 22nd February at 6pm. If you care so strongly about this accident waiting to happen, do something positive for once and bring it to their attention. I was invited by an agent friend of mine a couple of weeks back but will not be able to go as I'm in Phuket until next week. I would suggest anyone who shares these concerns go along and bring it to the clubs attention. Mike, you would go up in everyones estimations if you did this.

I don't think the Light House Club will kick your head in and Flanaggans is not a building site as I far as I know. 100 baht for members and 200 baht for non-members, which is cheap as food and drink is laid on.

I have been informed that the Governor of Chonburi has received a letter to inform them that Anti Corruption Department in Bangkok has started an investigation of Pattaya City Hall and the VT7 building permit. This doesn’t look good for the intern court decision. Rayon court has not given a final decision so the injunction could be restated.

Yes, I heard today a complaint was file at the Supreme Admin Court in Bangkok. It about vt7 construction is now in violation of their court order.

Now we wait and see what happens next. Is this going to be a three story condo?

I read a letter from and signed by Director of Department of Civil Engineering and City Plane in Bangkok to a admin court judge.

I asked my Thai friend who followed the court filings and believe in the Kings good action in setting up a fare court call Administrative Court system about the ruling.

Who said in anger the expert witness was wrong!

Is stopvt7 gloating because he thinks they are going to win? Is he gloating because he keeps saying “Thailand is a country of laws?” I don’t think so.

Matter of fact I also agree that Thailand has laws.

BANKRUPT VT7!

If (when) the law suit is filed against vt to tear down vt5 and vt3. I been told the Administrative Court will follow the law and tear down these buildings. This act will bankrupt vt.

Then realtor would be brought into the case to fund the liability. Claiming you didn’t know the law is not a defense against liability.

If you purchase for investment a vt condo and sold it then its tore down you are also liable.

LOOKAT. Give it a rest. Do yourself a favour and go and buy something in VT7. Think of those great sea views and the sound of the waves. Then rent out your old place. There will always be a market for older style, cheap accomodation with good views of the new developments like Ocean 1.

And of course, the everlasting sounds of hammering, sawing, drilling, tile cutting, stapling, for years and years until all the shells are finished and then when completed units are sold and new people move in and renovate it will all start again. Is VT company renowned for its insulation? Not to mention the dust and running out of water and the management.

I would not buy from vt because I see how their being build. Also I do not think vt7 ever get a occupancy permit?

Yes, I can confirm that the governor’s office requested copies of all document from jcc committee for a investigation. They were surprise and think their some Thai were behind the starting of Anti Corruption Department investigation of the issue a building permit to vt7.

FYI; This Act shall be called the “Organic Act on Counter Corruption, B.E. 2542 (1999)”. http://www.nccc.thaigov.net/nccc/en/NCCCACT.pdf "corruption" means the performance or omission of a particular act in office or in the course of official duty, or the performance or omission of a particular act under the circumstance likely to cause other persons to believe that the person so performing or omitting holds such office or has such duty although the office or duty is not held or assumed by such person, or the exercise of power in office or in the course official duty with a view to acquiring undue benefits for his or her own or for other persons;

On February 15 an appeal was filed to the Supreme Admin Court.

I forgot to mention the strong possibility that a highway will be built right in front of you.

Tammi you forgot the proposed helicopter landing pad, the worlds largest and loudest 24 hour open-air discotech, the howling stray dogs home, the shophouse abbatoir and the Wat doing cremations. The Harley Davidson muffler removal service station and the new Karaoke bars will blend in beautifully along with the drug rehabilitation centre and the missionaries outreach centre for Aids sufferers, alcoholic derelicts and the mentally challenged.

What else do you think all that space covered in lovely green grass is for?

I can't wait. Such local colour, such interesting views. A veritable home from home.

Have had a quick look. Can't find much apart from very welcome highway mentioned on new Ocean 1 information.

Anyway, what have you got against highways? Without them how could the new emerging Jomtien develop and thrive? Ocean 1 will have triple glazed windows. People will adapt. Thats how we got to where we are.

I'm sorry, I thought you were a VT7 home owner.

I have nothing against highways per se. Just thought I would mention could happen beachside at VT7.

You are right in that we do adapt but unfortuately usually to our detriment. When we are young we move to find beauty, peace, no pollution, but as we get older moving becomes less of an option so we have to contend with rising crowds, pollution, noise, and crime, inadequate public services.

1. JCC group is appealing the Admin Court's decision that VT can build VT7 over 14 meters.

2. Criminal investigation by Anti-Corruption Department.

Can you also confirm that JCC group has dismissed AsiaLawWorks and hired a new lawyer?

2. Criminal investigation by Anti-Corruption Department.

Can you also confirm that JCC group has dismissed AsiaLawWorks and hired a new lawyer?

1. The JCC appeal was file on Feb 15 ito the Admin Supreme Court Bangkok.

2. A criminal investigation was stated by Anti Corruption Department from Bangkok. The group was surprise when they were informed by the governor’s office that an investigation was started and was asked for copy of documents.

3. Yes they have dismissed Asia LawWorks. The court was informed. Their feelings that they were misrepresented at the last court hearing! They said everyone know you don’t measure into the sea when reading Issue 8 and 9.

I was told their no final order and the case and it goes on.

Also anyone who takes time to read Issue 8 and 9 knows it said nothing about measuring into the sea and they feel the law strong in their favor. It is informative and uplifting in how positively they are about the Thai law. They feel injunction will be place on vt7 again by the Admin Supreme Court but that will take time.

Is Thailand a country of laws? I think it is a country of laws! And many people will find out.

If Pattaya doesn’t care to protect the environment and the beach for Thailand’s and tourism industria future? Why would anyone want to invest in Pattaya or Thailand?

Go read the reason for Issue 8 and 9! Issue 8 and 9 were written to protect the beach for environment and tourism by requiring no buildings over 14 meters until you are 200 meters from MSL. The law is very clear about the 200 meter measurement.

Why don’t you take time and think about why would anyone want to invest is a condo if the government can change the meaning of a law without any logic or written word in the law such as you measure into the sea 100 meters before you measure onto the land 200 meters? :D

The court case has to two important aspects the environment and foreign investment and will Thailand enforce the laws to protect both.

It’s not about a our sea view! :D

Or VT7 investors to make money! :D:D

Setting of 200 meters measured from the construction control line on the map annexed to the Royal Decree Promulgating the Building Construction Control Act B.E. 2479 in the regions of Tambol Bang Lamung, Tambol Nhong Plalai, Tambol Na Khua and Tambol Nhong Prue of Amphur Bang Lamung of Chonburi Province B.E. 2521 at the sea side in which the following constructions shall not be built:

1. Place for keeping and selling fuel

2. Theatre

3. Wooden shop

4. Concrete shop house

5. Market

6. Garage or paint shop for car, motorcycle or motor boat

7. Warehouse

8. Building of 14 meters higher than road level.

The Ministerial Regulation is hereby given on the date of twenty-third of November B.E. 2521 (1978).

Note: The reason issuing this Ministerial Regulation due to the updating of the construction control areas in Tambol Bang Lamung, Tambol Na Khua and Tambol

Nhong Prue, by extending the construction restriction areas as appeared in the map annexed to the Royal Decree Promulgating the Building Construction Control Act B.E. 2479 controlling over the regions of Tambol Bang Lamung, Tambol Nhong Plalai, Tambol Na Klua and Tambol Nhong Prue of Amphur Bang Lamung of Chonburi Province B.E. 2521. It is, therefore, appropriate to amend the Ministerial Regulation No. 8 (B.E. 2519) issued under the Building Construction Control Act B.E. 2479 governing restriction of the construction of some kinds of building within the controlling areas under the aforesaid Royal Decree.

By the virtue of the Section 15 of the Building Construction Control Act B.E. 2479, the Ministry of Interior issued the following Ministerial Regulations:

1. This Ministerial Regulation applies inside the boundary line shown in the map annexed to the Royal Decree Promulgating the Building Construction Control Act B.E. 2479 in the regions of Tambol Bang Lamung, Tambol Na Khua and Tambol Nhong Prue of Amphur Bang Lamung of Chonburi Province B.E. 2479.”

2. The land areas under this Ministerial Regulation are restricted from construction of the following buildings:

1. Cheese or artificial cheese factory

2. Factory to produce soy sauce, fish sauce, shrimp paste, pickled shell, etc.

3. Slaughterhouse

4. Tanning house or storage of animal horns, animal skin, animal bones or furs

5. Place for cloth dying which yield bad smell

6. Fish steaming or boiling house

7. Soup factory

8. Animal fat, skin, or tendon stewing plant

9. Oil stewing plant of any kind

10. Shell lime or cement plant

11. Flour mill

12. Whisky, beer or alcohol brewery or refinery

13. Animal farm with smell, waste, and noise pollution

14. Manufacturing plant with smell, waste, smoke, dirt and wastewater which may be polluted and harmful to public health.

3. Setting of 100 meters measured from the construction control line on the map annexed to the Royal Decree Promulgating the Building Construction Control Act B.E. 2479 in the regions of Tambol Bang Lamung, Tambol Na Khua and Tambol Nhong Prue of Amphur Bang Lamung of Chonburi Province B.E. 2479 at the sea side in which the following constructions shall not be built:

1. Place for keeping and selling fuel

2. Theatre

3. Wooden shop

4. Concrete shop house

5. Market

6. Garage or paint shop for car, motorcycle or motor boat

7. Warehouse

8. Building of 14 meters higher than road level.

The area under Article 3 above,

Construction of building, house must be at least 8 meters away from Highway No. 3135.

Building or house construction must be provided with 75% open, and uncovered space of size to the land plot on which the construction is applied for.

This Ministerial Regulation is given on the date of twelfth, June B.E. 2519 (1976)

Note: The reason issuing this Ministerial Regulation is that further to the Royal Decree Promulgating the Building Construction Control Act B.E. 2479 applying to some areas of Tambol Bang Lamung, Tambol Na Klua and Tambol Nhong Prue of Amphur Bang Lamung of Chonburi Province B.E. 2499, and the aforesaid areas are open public resorts. It is appropriate that the areas shall not be allow to construct some kinds of building considered to disturb good environment and generating any kind of wastes, pollutions. This Ministerial Regulation is, therefore, issued.

We think Rayong Admin Court was mistake in lifting the injunction before a final decisions on Issue 8 and 9. So we have appeal their order to the Administrative Supreme Court located in Bangkok. :o
