Non-Imm 'B' visa - leaving Thailand

I hope somebody can give me some up-to-date advice on my situation, please.

 

Presently, I am on an extension of stay to a Non-Imm 'B' based on work, issued at Udon Immigration. My employer and I are currently in the process of ending my employment amicably. I just need some info here from you who are much wiser than I.

 

My understanding is that on the agreed date of cessation of my employment, my employer will cancel my work permit and I will need a copy of the work permit cancellation form to take to Immigration to cancel my extension of stay. 

 

1.  I live in Udon. Can I take the work permit cancellation form up the road to Nongkhai Immigration within an hour and exit Thailand, or will they tell me to cancel at Udon, get a 7-day extension, and then leave at Nongkhai?

 

2. If I can exit at Nongkhai within an hour of cancelling my work permit in Udon, will I have to pay any overstay fine (for the 1 hour from Udon to Nongkhai)?

 

3. If I can exit at Nongkhai within an hour of cancelling my work permit, can I just cross into Laos and immediately return to re-enter Thailand on a visa-on-arrival? If this is possible, will I get 15 or 30 days at Nongkhai?

 

4. I may have to visit my home country soon for a family reason. If that date coincides with the cessation of my employment, can I take the work permit cancellation form to Suvarnabhumi Airport Immigration on the same day and exit Thailand, or can I just exit at Suvarnabhumi regardless because I have a flight booked (without the work permit cancellation form)? If the latter, will there be any difficulties in re-entering Thailand and getting a 30 day visa-on-arrival?

 

I ask because i have heard of people who wish to exit the country to cancel an existing extension of stay based on work who have been prevented from doing so, and have been told to formally cancel their extension of stay at the Immigration office where they got it from, before being allowed to exit Thailand. Is that true?

1. Nong Khai would not cancel your extension. 

    You need termination letter dated for day you job ends to have it canceled at Udon.

2. You have until midnight on the day your extension is canceled to leave the country. You could go to immigration a few days before the date on a termination letter and they post date the cancelation to day to give you time to leave the country.

3. You could that.

Unless you are from a country that qualifies for a 15 day visa on arrival after applying for it you will get a 30 day visa exempt entry.

4. They do not ask for the termination letter at airports. Only a couple of land border crossings want it.

Would Nong Khai Immigration let me out of Thailand if I had the termination letter and work permit cancellation form, or would they insist on cancelling the extension at Udon first?

Sorry, I used the wrong term. I meant the 30-day visa exemption. I am Irish. Does Nong Khai give these 30-day visa exemptions as it is a land border, not an airport?

Yes you will get get a 30 day visa exempt entry. The 15 day entry at land borders was rescinded over 3 years ago.

If you had the termination letter the would let you leave the country at Nong Khai.

That's good news! Thank you! Do they need to see the work permit cancellation form from the Labour Office too? Does the termination letter have to be addressed to a particular organization i.e. Labour or Immigration?

 

As for being allowed out and coming back in on the same day, do I still have to get the visa for Laos, or is there a different situation for walk outs and back ins?

Best to have the work permit cancelation in case they want it. The letter could be addressed to immigration.

You will have to get a Lao visa on arrival so that you can enter and depart Laos.

If I go to Nongkhai nand cross into Laos and back again, what do Thai Immigration want to see to grant a 30-day visa exemption?

Apparently, Nongkhai Immigration and the border are not one and the same. The border officers will not cancel the extension of stay, but will let you depart if you have already cancelled at a "proper" Immigration office.

To cancel you extension it would be addressed to immigration.

There are forms for the work permit cancelation that have to be submitted,

You have to enter Laos before returning to Thailand and you will need to get a visa on arrival to do that.

Thai immigration checks for the Laos stamps when you try to enter the country.

Best ot cancel it a Udon immigration. Just go to a day or 2 before the termination date and the will post date the cancelation to that day.

At the bridge they would send you bank to the immigration office in Nong Khai if it is open.

Will Udon Immigration do that without the work permit cancellation form as the Labour Office are insisting on this on the actual day of cancellation?

You can cancel the work permit before going to immigration. It could be done the day before you go to immigration.

My employer called the Labour Office yesterday and asked if I could cancel the work permit in advance and they said "no". I thought they could do that.
