Non-O based on Marriage

Hello, 

I'm asking for a friend. He has an 1 year Multiple Entry Non-O Visa based on marriage. His wife isn't in Thailand and they don't have a child. But he has all the required documents for a new Non-O Visa.

 

In May or April this year (after the amnesty was announced ) he was a little bit concern and went to the immigration with the embassy letter to get the 30 Day extension even if his Visa and "permission of stay" was still guilty.

 

This Month(July) under the Amnesty his Visa and "permission of stay" expired. 

 

My question:

Can he still get a, I think 60 days?, extension based on his NON-O Visa when he already went to the immigration and became the 30 Days extension with the embassy letter? 

and If it still possible, what I think, does it matter that his wife isn't in Thailand for the extension?

His wife has to be with him when he applies for the 60 day extension to visit his wife. That is a firm requirement so he would not be able to get the extension.

At this time he can stay in the country until September 26th.

A few years ago I extended for 60 days at Jomtien IO while my wife was out of the country. They let me do it but I had to provide a dated, signed and printed e-mail from her explaining that she was away and asking them to kindly extend my visa. So it may be worth asking the IO about that.
