Appeals court halts special master review of Mar-a-Lago documents

An appeals court on Thursday ruled to scrap the appointment of a special master to review documents seized from former President Trump's Mar-a-Lago residence.

 

Why it matters: It's a major defeat for Trump and a victory for the Department of Justice, which has pushed to end the third-party review. The decision allows the DOJ to continue its probe into the former president's handling of classified documents.

 

What they’re saying: "The law is clear," the appeals court wrote.

But the sob still wins something: he got about six months of delay.  Maybe this can be extended to a SCOTUS appeal.  Now on to the next blocking move -- unfounded claims, faulty reasoning, ridiculous accusations. Buys more time.

The panel of the Atlanta-based 11th Circuit Court of Appeals ruled unanimously that U.S. district Court Judge Aileen Cannon erred both by granting Trump’s request to block investigators’ access to the records and in her decision to appoint a special master to assess Trump’s claims that some of the documents could be protected by executive privilege or other legal doctrines.

“We cannot write a rule that allows any subject of a search warrant to block government investigations after the execution of the warrant,” the three-judge panel wrote in a 21-page opinion released late Thursday afternoon. “Nor can we write a rule that allows only former presidents to do so.

The third judge was Republican William Pryor who was nominated by POTUS G.W. Bush but initially installed in 2004 as circuit Court Judge. In 2005 he was confirmed to the Eleventh Circuit.

Seems Trump will win if he can keep adding roadblocks and delays until the Republicans take control of the house in January. Unless, of course, there are ten or more Republicans that believe in law and order.

This investigation is unrelated to the House or politics.

I am STILL waiting for justice to be applied equally to all. The same law that should keep him from running SHOULD have prevented Hillary from running in 2016, but there you go, that didn't even slow her down.

Strange, isn't it. So many people in the USA and the best candidates they could come up with were Mrs Clinton and Trump. And that the only person in America who couldn't stand for President was the President.

What happens in Congress is irrelevant to what happens in the Justice Dept and in the Court system.

Actually it was close to 3 years delay. And from what I watched on tv and other media there is NO delaying avenues available to Trump now. The tax are returns are already (as i write this) in the hands of the Committee  Chair, and are being diligently reviewed.  this review will be to assess necessity to refer for criminal indictments, and since they now hold the returns to receive applications from other agencies and interested parties who are pursuing other avenues of investigation e.g NY Attorney Generals investigations and court tabled doc's re: Trumps serialised tax fraud in NY state and NY for further action.

The first judge a male who received the original request subpoena/order or whatever it was from Congress to hand over the tax returns (I can't recall his name) simply put the request/order aside and left it sitting metaphorically on his desk for nearly 3 years! Some justice system huh.

I watched the US news (a few feeds and a few others independents from Aussie and other places) and its clear in the text from the Courts ruling that they have no further, zero tolerance for this, as they described 'unlawful and no-leg-to-stand-on rubbish filed by Trump to deny Congress form seeing a citizens tax returns - its a clear and simple law apparently  ... The Court called out the disregard of the law. They also gave that deplorable Trump cultist Judge Cannon a total serve. I just saw a Midas Touch - Facebook feed that said Judge Cannon was just found crying in her chambers after reading the courts judgement.

I think Trumps really in trouble this time. Letitia James is going for the throat and if his now released tax returns are open to her investigation Trump could be had on Rico charges which is a decades long confinement should he be found guilty and given a charge and conviction commensurate sentence. let's hope so. The conviction of that head Oath Keeper sc.mb@g yesterday also puts Trump and those around him on notice that they are now if convicted of same charges facing long years behind bars. 

If Gerald Ford hadn't thrown the Law out and pardoned Nixon many would not have dared to do as they have done in these recent years.

You do know that the justice department reports to the attorney general and that the attorneys general are elected? There is nothing independent about that.

A Republican Congress can impeach an AG and remove him from office, replacing him with a more amenable officer.

I sincerely hope that you are not an American. Attorneys General are not elected. They are nominated by the President and approved of (or not)  by the Senate.

Also, it's clear you understand what impeachment means. It's analogous to "indicted". The House impeaches and the Senate gets to convict or acquit. The Senate is where the trial takes place. It takes at least 2/3 of the Senate to vote in favor of conviction for a cabinet officer to be convicted.

I'm glad you put a "could be" in that. I expect nothing much to be found, given they were audited before, or are some claiming the IRS ignores crime?

In a refreshing change, Trump's legal team apparently decided not to appeal the decision of the panel. Maybe there's only so much humiliation that even they can endure.

Lawyers who back former 45 are facing a campaign, launched by fellow members of the legal community, aimed at potentially disbarring these attorneys. They're not stupid, they see the handwriting on the wall.
