Donald Trump will not speak during the closing day of his civil fraud trial in New York.

After speculation over whether the former US president would make a statement, the judge shared emails showing he had not agreed to limits on what he could say.

"Take it or leave it," the judge told Mr Trump's lawyers. "Now or never."

Mr Trump's team also asked the judge to postpone Thursday's hearing because of the death of Melania Trump's mother.

But Judge Arthur Engoran said he was "sorry" but the plans and schedules had already been set.

 

Mr Trump's civil fraud trial is resuming in New York City on Thursday, when lawyers for both sides are set to make their closing arguments.

The former president and his two adult sons are accused of massively inflating the value of their properties by hundreds of millions of dollars in order to secure better loans. They deny any wrongdoing.

The judge in the case has already ruled that they committed business fraud, but the trial is focusing on six remaining charges - and the judge must also decide how much to fine Mr Trump in penalties. It is not a criminal trial.

The prosecutor, New York Attorney General Letitia James, is asking for Mr Trump to be fined $370m (£290m) and be banned from doing real-estate business in New York.

 

 

'Take it or leave it'

For days, there has been speculation in US media over whether Mr Trump might speak during the closing arguments.

But on Wednesday, Judge Arthur Engoran released emails between himself and Christopher Kise, one of Mr Trump's lawyers which suggested it would not be happening.

Looks like judge engoran isn’t gonna let trump turn this fraud trial into one of his gas light festivals good for him and yes chomper I wholeheartedly agree trump will try to claim he was denied the chance to speak.i would bet money 90% of New Yorkers are absolutely delighted trump is being run out of town!

I stated facts, not some made up BS. Try reading the articles not just the headlines, or do you have the same attention span of your hero?

 

It also shows a lack of intelligence and imagination to have to result to trying to use ‘woke’ claim. Maybe shows that you are too arrogant to see your own ignorance.

Restrictions were put on what Trump could say, including not making a campaign speech, not bringing up irrelevant items, sticking to subject and perhaps even speaking some factual truth. Trump would have had literally nothing to say.... restricted items are bread and butter of his blatherings. He was left speechless

Well that an the risk of setting himself up for criminal prosecution by running his mouth.


If prosecutors can stomach the stench his mouth is an evidence rich environment.

 

If I were Trump's attorney, this would be my closing argument:

 

"Your honor, it's clear we have a difference of opinion on Mr. Trump's business practices, but you are the judge, and it's your opinion that matters.

 

So, I would like to suggest that you ask the banks and insurance companies how much money they lost due to Mr. Trump's business practices, and we would be happy to compensate them for any losses".

 

To the extent that Trump's lawyers go on the offensive in their close, Trump will have to pay big money.

He did get to speak, so that's one less thing the snowflake can whine about.

 

For unknown reasons, trump's legal team chose a bench trial rather than a jury trial. They had a choice. The judge then ruled that trump had committed fraud.

 

trump was able to get much lower rates because of his lies. At that time he was also heavily investing in Atlantic City casinos, so he had poor cash flow. The low rates he got via his lies helped, but he also siphoned money off of his casino projects, which he funded via 72 banks plus via the issuance of junk bonds. So he was only able to repay the fraudulently favorable NYC rates because he siphoned off his NJ projects.

 

A key part of these deals is that the NYC borrowings had personal guarantees, while his NJ properties were only guaranteed by the land and projects themselves. So bankruptcy of his NJ properties would not hurt him personally, while non-payment in NYC would have hit his own wallet.

 

When he had siphoned off enough from NJ to repay his NYC borrowings, he filed for Chapter 11 bankruptcy for his NJ properties, stiffing the banks, bondholders and the subcontractors he had used in the construction of his casinos.

 

It is possible that the AG of the State of New Jersey will consider doing what the NY AG James has done, and charge trump with fraud for siphoning off funds to use in areas not entitled by the junk bond covenants for his casinos. That would also fall under SEC rules, so federal charges might result.
