Former FBI Director James Comey has been indicted for a second time by the Justice Department (DOJ), multiple sources told Fox News. The charges appear to be related to a May 2025 Instagram photo of an "86 47" shell formation on a beach.

Comey is charged with "knowingly and willfully making a threat to take the life of, or inflict bodily harm upon, the President of the United States and knowingly and willfully transmitting a communication in interstate and foreign commerce that contained a threat to kill President Donald Trump," according to the indictment.

I'll let Bongino take this one, in a long form interview with Hannity:

“So we walked into this total shatshow, this Biden mess, you know, illegals everywhere. The FBI focused on locking up Donald Trump and not bad guys.

Like Bongino, I believe there are still a lot of FBI snakes covering for Comey because they were in it up to their eyeballs, too.

I've been 86'd a few times. It happened several times to my friends as well. It was only an inconvenience and often I just walked away before it actually happened. It was rare that the person being 86'd had actually done anything wrong.

86'd just means the person is no longer welcome. In Nevada, if you return to a casino after being 86'd you can be charged with trespass.

A few casinos saw me as a drag on their bottom line and 86'd me and sometimes my wife as well. Casinos are private property and the owners do have the right to exclude people arbitrarily.

US voters (or Congress) can legally 86 any president. A totally shameless prosecution of NO CRIME. LOL. LOL. @GOP demand for free speech!

Apparently in what has become a Snowflake Nation, ostensibly led by the Snowflake-in-Chief, whose skin is thinner than the garish gold leaf he plasters everywhere, shells on beach sand is far more "dangerous" than pedophiles, or guys who try to overthrow democracy because they can't handle losing an election, or child molesters who also attacked the US Capitol on 6 January 2021, but whose terrorism was pardoned by Trump, allowing them to go on and molest kids.

Anyway, since the war may no longer distract from the Epstein Files, Trump needs another thing to try to capture attention. Obviously he cannot claim any policy successes, like "no forever wars" or "affordability".

My question to the Trump/Blanche DoJ as to what constitutes a reasonable recipient: Do you know any?

Anyone who saw that picture on the beach and considered that a serious threat might be considered as UN-reasonable.

The likelihood this ever goes to trial is slim to none, but if it ever did, Comey's defense should be:

"It's just typical tourist behavior"

That worked for people who searched for the Vice President in order to hang him, even getting them a pardon.

I do wonder if "antifa" stormed the White House around noon on 6 January 2028, set up a guillotine on the South Lawn, and chanted "Behead the Orange Traitor", would the incoming POTUS---such as Elisa Slotkin or Josh Shapiro or Wes Moore---pardon them?

There certainly is precedent, set by Trump himself.

The governments argument will be based on inciting violence. “86” is a term used to eliminate. He posted it on the internet. If there were no history between Comey and Trump, then there would be no argument to render.

The Left, including Comey, opened up the Lawfare Genie's Bottle during Trump's first term and during Biden's presidency. Now that the genie is out of the bottle, best of luck attempting to shove him back in. Lawfare will now become the norm as Comey is about to find out. As we said back in the day, "Karma's a b***h."

The charged statute 18 U.S.C. § 871(a) involves a person making a direct threat to the president or other covered official.

The statute in getting another person to act is:

18 U.S. Code § 373 - Solicitation to commit a crime of violence

And the indictment mentions no word inciting or similar to get someone else to act.
