Pubs are set for new planning protections aimed at stopping viable local boozers being transformed into homes, offices or commercial premises under sweeping changes to England’s planning rules.

Developers face a tougher fight to close pubs

Housing Secretary Angela Rayner is expected to introduce the protections immediately, with developers required to demonstrate that a pub has little realistic prospect of survival before a change of use can be considered.

The move follows mounting pressure on struggling pubs, which face rising business rates, alcohol duties, employer National Insurance, minimum wage costs and soaring energy bills. The Telegraph’s Save Our Pubs campaign has urged ministers to reduce the tax burden on landlords.

Under changes to the National Planning Policy Framework, a viable pub would therefore face a stronger presumption against redevelopment.

But ministers are simultaneously clearing the way for homes

The pub crackdown comes alongside a major push to accelerate housebuilding. Developments within a “reasonable walking distance” of well-connected railway stations will receive a “default yes” under the revised planning framework.

Rayner said the changes would unlock thousands of homes near transport hubs and help people live closer to work, schools and essential services. The Government is seeking to build 1.5 million homes in England over the course of the Parliament, but remains behind the pace required to hit that target.

Local opposition faces a fresh squeeze

The planning overhaul will also reduce the influence of some local objections where they conflict with national priorities. Several organisations will lose their status as statutory consultees, including the Gardens Trust, which warned the change could put parks at risk.

The Conservative opposition accused Labour of attempting a “power grab” after falling behind its housing target, while ministers argue the reforms are necessary to overcome planning barriers.

The changes leave councils facing a delicate balancing act: protecting pubs and community assets while simultaneously opening the door to far more development around transport infrastructure.
