Thailand Introduces Expanded Deportation Rules for Foreign Nationals

Thailand’s new deportation regulations took effect on August 28, 2026, creating a clearer process for removing foreign nationals over immigration, employment and other serious legal violations. The rules also allow deportation when a foreigner is judged to have acted against public order, public wellbeing or accepted standards of morality, including people who encourage or assist such conduct. Foreigners who complete prison sentences for offences such as illegal entry or stay, unauthorised work, unlawful business activity, document forgery or crimes carrying at least five years in prison may be referred for deportation after release. Authorities must share case information with the Interior Ministry, and deportation orders may include a temporary ban on returning to Thailand. The regulations also allow transfers to a third country or international organisation in certain humanitarian circumstances, including cases involving risks of torture or enforced disappearance, provided the deportee agrees and the receiving party covers the costs.
