Thai Child, Farang Father Absent

Featured Replies

The situation:

A Thai child with a Farang father who has left Thailand and no longer viists or supports the child.

Under Thai law does the child need the fathers' consent to:

1) Obtain a Thai Passport?

2) Obtain a Visa for a foreign Country?

3) Travel outside Thailand travel outside Thailand?

1. I had to be present to take the passport of my child.

2. Might depends on the country, but do not think so.

3. I had my child travelled with someone else, without the need of any signature from me.

1) If the father is named on the child's birth certificate then both parents must present themselves to apply for the childs passport or one parent and consent from the other or a sole custody agreement. See MFA Website

2) If the child holds a Thai passport they will need to obtain a visa to visit countries that require a Thai national to do so but should not need the father when applying, there will more than likely be a requirement of a signature of parent/guardian but as far as I've seen not both parents.

3) If the child has a passport and a visa for the destinatation country then travelling with its mother should be no problem. If travelling with another (especially Farang) it would be advisable to get a letter of permision from the mother.
