In this particular case the answer is Yes.

Generally an MP who has a final conviction (Supreme Court Ruling or a failure to appeal a verdict) is barred from remaining in his or her seat. There is however an exception for suspended judgements, where the offence is either defamation or is regarded as a petty offence. Constitution: section 105(11))

A case is regarded as petty when (as in this case) the maximum penalty for the crime is not more than 1 month imprisonment and/or a penalty not exceeding 1000 baht. These cases are held in the Criminal court (Petty crime Division).

Is the maximum penalty 1 month ie he got the highest penalty possible, or is it the case that the sentence was only 1 month, even though he could have got more?

The maximum penalty for this particular crime was 1 month in prison with a 1000 baht fine. It is classidied as a Class 4 (Petty offence) crime. Generally speaking when a court decides to suspend a sentence, they normally give a sentence towards the maximum amount permissable for the offence.

Hoping for a bit of clarification. Another paper says that we was convicted on the charge of assault. It would be amazing that the maximum penalty for such a conviction is only 30 days in jail, but I suppose anything is possible in Amazing Thailand. Is the penal code really that light on assault?

It also pointed out that in court the convict refused to apologize for the attack and furthermore he stated that his actions were intentional.

While it appears that this is his first actual conviction, given his checkered past, as highlighted earlier, it seems incredulous that this person will remain as a Member of Parliament.

I also guess nothing developed further from his earlier troubles justifying the degree he received from a diploma mill in the Philippines.

Guess he has been back to school since then.

A violent history

>> Karun Hosakul, 41, allegedly beat his former wife, Ratchadawan. In April 2005, she divorced him.

>> Two months after the divorce, Karun attacked her at Don Mueang Airport as she returned from a trip abroad. Karun grabbed her hair, slapped her and threatened to disfigure her. She was rescued by airport guards.

>> In 2006, Karun assaulted a guard at an abandoned cinema, when he and his friends were refused entry. He kicked the guard twice in the head, reportedly shouting: "I will be back. Don't you know who I am?"

>> In 2007, as a Bangkok City Councillor, Karun head-butted an undercover policeman at a cock fight.

>> In 2005, Karun was stopped from contesting a Bangkok seat because he lacked the educational qualifications required.

Whilst the particular crime is not mentioned it is probably section 391 of the Criminal code:

Whoever, commits an act of violence not amounting to bodily or mental harm to the other

person, shall be punished with imprisonment not exceeding one month or fined not

exceeding one thousand Baht, or both.

Other cases of assault where there are circumstances of bodily harm or grievous bodily harm are punishable with far more severe punishments.

As for the case you highlighted regarding contesting an election. Under the 2007 Constitution, only Cabinet Ministers are now required to hold a bachelor degree (or higher) qualification. An ordinary member of parliament is exempt from this requirement.

I wonder whether some Thai MPs might consider a similar bout, against PRC representatives, to raise money for charity ? :)

He's a Thaksin bag man. Nothing really incredible about it. Takki Shinegra needs men of honor like this, to defend himself against the people trying to steal his lawfully earned money. :)

Karun found guilty of libel

The Criminal Court has given Pheu Thai MP Karun Hosakul a suspended one-year jail term and fined him Bt40,000 after finding him guilty of libel against former Democrat MP Somkiat Pongpaibul.

The day after he kicked Somkiat in Parliament on April 2, 2008, Karun gave an interview to a radio and a television station which the court considered defaming Somkiat.

The court initially sentenced Karun to six months in jail and Bt20,000 fine for each interview.

However, since Karun has a clean record and is now an MP, the court ordered a probation of two years and told him to publish the verdict in three newspapers for three days.

Granted no-one should go to jail for defamation - but the reason given for it here is typical of these cases.

And being an MP shouldn't count in his favour. :rolleyes:

In this silly display of outrage by the usual suspects, they somehow forgot to mention that Somkiat Pongpaibul is a notorious PAD leader who has been repudiated by both Abhisit and, believe it or not, Suthep.I have no idea what Karun Hosakul is alleged to have said but by any reasonable standard the awful little quasi fascist Somkiat, too appalling and extreme even for the Democrat Party, certainly deserves a kicking.

Er, I think we know that since that is what the Nation's article was about.

My contribution was simply to note we are talking about, in the person of Somkiat, a reactionary of the first order - whom Abhisit and even Suthep disdain - poisoning the Democrats' good name.Some people - not you of course - might think this is an interesting and relevant point, and that Karun in giving him a kicking, if that is indeed what he did, was rendering a valuable public service.

I disagree with most of what you have to say but if someone else felt likewise and thought you deserved a kicking over it I certaintly wouldn't see that as a public service. I'd see it as assault and I'll bet you'd change your view and see it that way too.

There is CCTV in the room where the incident happened. Remains to see if it "didn't work on that particular day", as usual, or some high bidder can manage to get the recording tampered with.

If you consider someone with a history of physical violence, including domestic violence against his wife, is rendering a valuable public service, then it helps others to understand your point of view.

Your attacking, of all people the recipient of this violence, Somkiat, further clarifies for others.

Just sharing the disdain of the man, a notorious PAD creep, voiced by Abhisit and Suthep.Abhisit actually suggested he should leave the Democrat Party.

Odd you somehow didn't find the time to mention this, and now become agitated because I pointed it out.Or on the other hand perhaps not so odd because it doesn't fit in with your "narrative" of events.

If I was was a unreconstructed PAD ideologue I would deserve a kicking.Actually Karun probably does too - he looks to be a creep too.I just am amused at the way the usual suspects censor out anything that doesn't conform with their ideology, and then expect to be taken seriously.
