BANGKOK: --  Thailand is to deport a one-legged German accused of trying to infect nearly 100 Thai teenage girls with HIV through unprotected sex, his lawyer said on Friday.

A court sentenced Hans-Otto Schiemann, 56-year-old former sailor, to two months in jail for overstaying his visa as Thailand had no law to punish him for having unprotected sex, lawyer Warinporn Hongchumpae said.

"The court ruled that he had to be jailed for 58 days, which he has already completed while awaiting a court verdict," Warinporn, who was appointed by the provincial court, 340 km (210 miles) northeast of Bangkok, to represent him, told Reuters.

Schiemann, a native of Schweinfurt in Bavaria who had been living in the province for 10 years, was arrested in September and would be taken to Bangkok for deportation, she said.

Deliberate transmission of the AIDS virus is a crime in many Western countries and the majority of U.S. states. A Texan who knew he was HIV-positive was sentenced to life in prison in 2003 for sexually assaulting an 11-year-old boy.

However, in many developing countries, including those in southeast Asia where AIDS and commercial sex are rife, effective legislation to address the problem has not been passed.

Schiemann, who launched a tirade of abuse against Thai women and called them "witches" and "monkeys," refused a prison blood test to confirm his HIV status, but admitted to reporters last month he had HIV.

He said he had done nothing wrong.

If he is HIV positive, then I agree, but why the ###### wasn't he forced to take a HIV test, as he refised. At least then a lot of girls would know whether they have to worry or not!!!

well he may admit he is positive but still no proof but overstay,I don't think the Thai authorities are dumb but are just looking for a reason to deport the guy. Remember in some countries innocent till proven guilty. I must agree with this

It is really amazing how many honest and good people are using the opportunity here to demonstrate their being good human beings... Thanks to this sick monster! Now we know that we are good! Everybody must understand that we can only be good, now that we know how an evil man looks. We are not like that! So we must be good! And we can show that we are better by inventing more and more tortures for that sinner. He has to go to h e l l , and thanks to him we can feel assured that we can go to heaven, we are too different from him.

Thanks for the Thai journalists for this nice story. Thanks to you all for showing me that so many good people exist. Yes, throw the stones, all you good people, with every stone, with every new torture, there is new hope that mankind is still healthy, and evil has no place here.

That is besides the point whether to use condoms or not. The MAIN POINT HERE is this sucker KNEW HE WAS HIV INFECTED. Knowing that your are infected with a disease that has no cure at all, and then transmitting it to others is the same as committing MASS MURDER. Once these other people catch it, they are just as good as being dead. It is simply another DEATH SENTENCE WARRANT.

The same applies to DRUG DEALERS who peddle illegal drugs out to society in their quest for the money tree. Every illegal drug they sell they are also killing the next person slowly but surely, or ruining their very own HEALTH WELL BEING.

That is why I have no PITY WHATSOEVER to Drug Dealers and those who have HIV and knowingly transmit it to other innocent people without notifying them in advance of the consequences etc.

The next on this list is THIEVES AND SWINDLERS. They cause heavy losses to individuals and cause heavy economic ruin to individuals who work hard in earning a decent income making money of which they buy to enjoy, while these thieves and swindlers do jack nothing but use their con and artistic skills to manipulate you or steal you blind when your not watching your personal effects 24/7.

I have quite a lot of family in Thailand and as a result know a very wide range of people of all ages and walks of life. As unbelivably stupid as it is I know several of the retired expat community who have a different girl every night and NEVER wear a condom. I really can't belive they would do it but they do. I also think this german guy is scum for doing it but the fact is there are still a lot of people out there doing the same thing as him - some knowingly some probably don't know (for sure) that they have it. idiots... if they don't care about themselves - fine. But they are doing such wide spread damage to so many others.

The original news story was his wife (ex wife ?) telling the world that he has AIDs and had bought unprotected sex from school girls. The press stated the accusation at a number of over 100, and it having caused (potentially perhaps?) many thousands of cases as these girls passed it on. If I remember it was some crazy number like 15,000.

Now they are saying teenagers. They are saying they can not prosecute him for anything other than overstay.

Well if these girls (any of them), were under 17 then he is guilty of procuring a minor for sex (age of concent IF sex is being paid for - i.e. prositution). That would mean statitory rape.

So either:

a.) The girls were over 17 and the original statements from the local authorities was inflamatory and intensionally deceiving.

b.) No girls have come forward; so how could a figure be given at all?

c.) The authorities don't care, and are happy to deport and black list (doubtfull I think given the current administration)

d.) His wife made it all up, and the government are just staying schtum to keep the local authorities face.

Something just doesn't smell right about this. If he has done what he is accused off, then I am all for the full weight of the law for attempted murder/manslaughter/stat. rape/etc, but so far I see nothing but mist, rumour and unimpartial accusation.

In the states police are trained to truth-check someone who "confesses" to crimes, as there are mental conditions driving people to do this- and sometimes people confess to protect OTHER people who are really guilty. I get the feeling they don't do any of this here. So what evidence do they have?

Only the spoken word of this one crazy one-legged German that he's been sleeping with girls and paying them and trying to give them HIV. Has any girl actually testified that he did so? Have any medical tests substantiated any of this story? No. That certainly makes this character suspicious- but an attempted murderer? No evidence.

Think of it this way- if I walk around Thailand telling people that I've been shooting people from a distance (so that they don't know it's me) does TELLING them this make me GUILTY of MURDER, with *no other evidence* [dead bodies, witnesses, missing persons, etc.]? It makes me crazy, undesirable, antisocial, sure. But not guilty until you've got a body linked to me by evidence.

It's a good idea for Thailand to deport this guy, whatever he's been up to. But I would've thought the farang members of this forum to have better common sense and legal sense (not to mention skepticism) about what they read in the papers here (and was it 500 or 100 girls? [*cough*, yeah, right]). Again, I think this is a social problem pinned on a crazy farang because it's convenient to do so. Hope that the sane farang have more sense than to swallow the official BS.

The most telling piece of information about this story, other than the fact that not one "victum" of his scheme was quoted or came forth to the authorities, was that it was the X-wife who exposed him. His X-wife is dying of AIDS. This is the piece that throws this whole story into question because ex's who don't have AIDS are sometimes vicious and vindictive. I never want to meet an ex who has AIDS and is most likely bitter about contracting the disease.

So can it be said that the wife "exposed" him and confiscated all his property? We don't know. We don't know much about this story. We only know what the authorities have been quoted as saying.

Not one victum has come forward...that puts alot of questions in my mind.

No one would argue that if the allegations are true that he could be prosecuted on many different charges than "trying to infect teenage girls."

I believe that this crime ("trying to infect..") just does not exist in Thailand. But you would think there is an argument for "attempted murder" if he is knowingly HIV positive.

It is unfortunate that some of the gaps between the lines have not been filled in, even though they are known by the police and support workers associated directly with this case, but bound by international privacy laws. As a psychologist with one of the NGO's stationed here in Thailand, we were involved with the investigation of the girls who had been possibly infected.

It was not the ex-wife who initiated the complaint about her husband. It was a verbal complaint made from many of the village heads, who's residents were left to care for the ex-wife now that she was to a very serious stage of the disease. Her story was picked up by someone in the know and it was released nationally - and subsequently - internationally.

Please do not think that because there were no women who made public statements, that there were no women who used the more subtle channels of the NGO assistance and support services to quietly voice their fears and seek to have blood tests completed.

Patient confidentiality will ensure that any students who may or may not be under age and do not want to be identified to the nation or the world, will remain under this veil of secrecy. You can be assured that with the world spotlight traced directly on these women that they would have their names plastered in every newspaper across the globe.

This is the driving reason why these women are not willing to put a public face to this. The women are well aware that media in other countries taint all Thai women as prostitutes, and do not wish this shame on their families to have their photo as the front page news world wide. Journalists are not exactly renouned for treating delicate situations with kid gloges (my apologies to any journalists amongst us)

As far as the German not providing a blood sample on request, and the lack of "forcing him" to provide one, the answer is simple. You will not find a security guard in a public prison system being paid less than 7,000 Baht per month, to risk his own life, or the life of his family, by attempting to stick a syringe into the arm of a man who has shown some unstable mental tendencies. It is therefor up to the doctor, and there is no law anywhere in the world that gives a medical practitioner the jurisdiction to administer you an AIDs test to prove either your innocence or guilt, without your expressed signed permission.

Although I did not want to enter into this discussion, and remain a passive observer, I was saddened by how far off track some people were steering their accusations. Unfortunately, due to draconian laws (even the local authorities admit that) the issue of unprotected sex in Thailand whilst knowingly HIV positive is not a legal one, but a moral one. I therefore will not port my professional opinions upon this forum, but would like to affirm that the majority of girls who must procure clients for this act do it solely as an act of family income and survival. The women who enjoy "ripping off" farang are in the minority and in the more commercial areas where high tourist flows allow this to take place. I do not condone, nor condem, prostitution, however gentlmen and ladies of this forum, please remember that every lady has her different reasons and justifications for working this vocation, and it is not for us to stand above and preside upon the mirality of their decision. Lets all keep an open mind and enjoy this beautiful land, and it's wonderful people, for whom and what they are.

Thwe bizzare way that journalists print numbers leads to false conclusions by their readers.

If these 100 or more girls actuall passed AIDS onwards to 15,000 others,

then they must be very active girls. And, if they were that active, who is to say

that they actually got aids from this guy in the first place?

He is scum, no doubt, but he can be prosecuted for only the crime for which he

has committed.

A former German sailor who boasts he has infected hundreds of Thai women and girls with HIV-AIDS was detained by a court yesterday - for immigration offences.

Hans-Otto Schiemann, 54, claims to have HIV but has refused to take a blood test since he was arrested last week. As he was led away yesterday he told reporters he had committed no crime. His common-law Thai wife has full-blown AIDS.

Officials say they are powerless to charge him for his sexual activities. But they did print 2000 flyers warning students to avoid him and posted banners throughout the town of Chaiyaphum in northern Thailand.

Sommart Troy, of the Thai group AIDS and Social Concern, is demanding that authorities carry out an HIV test to confirm Schiemann's claims.

"We are concerned with his rights but if you know you have contracted it and go to have sexual intercourse with someone it's like intention to murder in general law. I think he should be held for further investigation. It's not yet proven he has HIV," he said before yesterday's hearing.

The one-legged German, who claims he had unprotected sex with hundreds of Thais, was remanded in custody for a month. Authorities claim the former sailor overstayed his 30-day visa by three years.

Health officials did not know how many women were infected, because many were reluctant to have an HIV test, but that it could be as high as 400.

Schiemann told Agence France Presse last week that he had contracted HIV three years ago. Neighbours said he drove around town offering large sums of money to students for sex and also frequented karaoke bars to pick up women.

Schiemann, who had no legal representation yesterday, is due to reappear in court on November 15.

As he was led away, Schiemann said: "It's unfair to put me back in jail. I haven't committed any crime.

"I have the right to stay here in Thailand but now I have to stay in jail another month. This is a complete scandal, there is no justice in Thailand."

If found guilty, Schiemann is likely to be deported, according to Lieutenant-Colonel Khampol Nonuch, who is heading the investigation.

To follow your logic, you therefor deem that doctors enter into a prison cell to exam a prisoner alone. World Health Organization guidelines prohibit any medical employee from examining a prisoner unless accompanied by 3 enforcement officers from the holding facility.

When taking a blood sample from a prisoner who has issued written consent, the enforcement officers are required to act as observation staff only who instigate action based only on aggressive mannerisms of the prisoner. A medical employee is restricted from extracting blood samples, or conducting obtrusive tests, unless the prisoner has issued written consent.

In the event that a prisoner captures a syringe, using this as a tool of threat or weapon, the enforcement officers must restrain and subdue the prisoner.

Having only one leg does not affect his reach nor his power to lunge and strike with a blood filled syringe. Farang are larger that Thai enforcement officers. There was never any implication that Security Guards take blood.

Well if you were a learned scholar Yuyi, you would realize there are a lot of international journalists who glean the thai forums looking for local snippets of news that is not covered by the international journalists elsewhere. I would hardly advertize to drive a mass of media frenzy to the NGO I have worked so tirelessly to support and develop. It would be more than my job is worth. The first part of your statement is the only part of your post that we agree on. However, ANY issue NOT bound by law IS a moral issue. Look it up in your own country's constitution. It's in the Thai constitution. It is not my interpretation, nor my opinion. That is the legal definition of fact. The fact is there is no law in Thailand that prohibits any individual, Thai national or alien, from knowingly or unknowningly transfering any disease - be it contageous or fatal. There is no arguement what we would do if it were in our countries, however, it has happen in Thailand and the only law bound infringement he has perpetrated is that of overstay. I do not condone his actions, but now it is receiving such high media exposure, the Thai police must play this one by the book.

You seem extremely knowledgeable on this subject 4431. I find it hard to believe, although I believe you, there is no law against the knowingly transmitting of a potentially deadly disease. Is there any other charge that could be brought about that would cover such an act? Such as, Willful intent to cause bodily harm or murder. I mean if you know what you are doing, you can kill somebody easily with a tightly rolled up newspaper. But it is not against the law to carry a newspaper. And a newspaper is not classed as a deadly weapon. What I mean is, if somebody folds a newspaper and rolls it up tightly, it becomes as hard as wood and a hard hit to the throat or temple, could potentially kill. What would be the charge?

If somebody got killed or injured, the choice of weapon would be a secondary consideration.

Claiming to intend to and have injured somebody with a rolled-up newspaper, while there are no confirmed victims, wouldn't usually result in long prison sentences or being stoned to death, psychiatric treatment might be recommended.

I don't know about Greece, but in a number of nations including Thailand basic principles of presenting and examining evidence exist in court proceedings. This also applies to one-legged Germans who supposedly have spread HIV.

Stoning to death is in most countries not regarded as an appropriate form of punishment, it is only used in primitive societies or under religious regimes. It would be a good mental and emotional exercise to try and figure out why this is so? Seems to me your moral judgement carries religious undertones.

If witnesses came forward there could be a number of charges against the guy, paying girls below 18 for sex would be one that might stick, in Thailand and in Germany. Considering the media coverage and the unqualified comments made on the internet, it is understandable there are no reported witnesses.

The issue of a forced HIV test is interesting, I believe in Germany it could be authorised, and he would be persecuted under German law, even if the crimes were committed in Thailand (subject to reasonable grounds for further investigation, which requires more than hear-say and newspaper reports).
