Hi everyone hope your all well.

i will be applying for a settlement visa soon , i am UK citizen and married to a thai girl and we have a 6 month old boy

I have registered him as a british citizen but have not got back the birth certificate yet and therefore cannot get his british passport until i do.

I would really like to get my wife and son over here asap and perhaps deal with the passport after as with only 2 visits since his birth i am missing out on being a father in these early stages of his life.

i have done my homework as such (thanks to all in the threads at thaivisa.com) and have all documentation and VAF4 form near enough ready to go

But im a bit confused on my son coming over before he gets his british passport.

so I wonder if you could help me please.

I have read some conflicting information and would like to know as my son will be just 6/7 months old when I apply:

1. Due to his age do I still have to apply for a "settlement visa" for him and if so i take it that will make another fee of £515 ? or is there an alternative in this situation?

2. if so do i need to submit a separate application form or just include him in the VAF4 in the "your Family" section ? i have read guidance notes part 4 but it doesnt really help with age/nationality

3. If he does need a seperate application form then i imagine it will be another VAF4? (unless theres an alternative above)

i also heard of a certificate of entitlement/right to abode for his thai passport but this just sounds like i may aswell apply and wait for the british passort?

or is there an easier or quicker way around this situation i find myself in?

You haven't done your homework, or you must have missed a major class at the beginning of term! :o The UK birth certificate and the UK passport for your son are completely seperate. You don't need a UK birth certificate for your son to get a UK passport. You need to get a translation of his Thai birth certificate with your name on it as the father, a couple of pictures of him and fill out the passport application form and take it to the embassy. You don't need to register his birth with the UK authorities at all if you don't want to. Registering his birth with the UK is a matter of choice. Many people don't bother as there aren't any real benefits, except to the embassy, who make a load of cash out of it.

For his passport you need the C2 form from this site.

CharlieB, yes i have definately missed something :-/ , i actually called the passport help line and they told me i need his birth certificate to obtain a passport ?!?

this was in the UK though, I already have a translation of the birth cert and my name is on there as the father.

I will look into this now thanks alot for the info and link.

Are you trying to get the passport in the UK or in Thailand? You should be doing the registration/passport application in Thailand. I did them at the same time I put my wife's visa app in. She got them both couriered to her about 2 weeks after I put the applications in at the embassy.

Forgot to answer your other questions. No, you don't have to fill out a form or pay for a visa for your son if you get his UK passport before he travels. On your other half's application you just need to put down in the relvant bits that you both have a son together. This will strengthen your application and should lead to you getting the visa ok. You should get his UK passport first. If you don't, then you will have to get a visa as he will only have a Thai passport.

I did it this way:

Travelled to BKK with completed C2 application, and UK birth registration doc. I put these two forms into the Embassy at the same time as I put my wife's fiance visa application in to the VFS centre. I dated my Wife's visa to start about 3 months after the date I applied (This is the maximum I believe). On my wife's application we put down that our daughter would be travelling with her and that we had applied to the Embassy for a UK passport. My wife got her visa about the same time as she received our daughters UK birth certificate and passport. This meant we didn't need to put an application in for the nipper as she had a UK passport.

thanks again for the further info you have been very helpful.

well this is where my homework failed :-( i thought i had to get my sons passport in the UK (needing his UK birth certificate) only and had no idea i could do it in BKK (my fault for assuming).

I understand if i have the UK passport i don't need a visa for my son but as i thought i had to wait for the UK passport in the UK i wanted to see if there were ways to speed up my wife and son coming to the UK before this, applying for the UK passport in BKK with the C2 form "should" solve my problem.

and yes I certainly have provided proof on my wifes application that we have a son etc.

Forgot to answer your other questions. No, you don't have to fill out a form or pay for a visa for your son if you get his UK passport before he travels. On your other half's application you just need to put down in the relvant bits that you both have a son together. This will strengthen your application and should lead to you getting the visa ok. You should get his UK passport first. If you don't, then you will have to get a visa as he will only have a Thai passport.

I did it this way:

Travelled to BKK with completed C2 application, and UK birth registration doc. I put these two forms into the Embassy at the same time as I put my wife's fiance visa application in to the VFS centre. Ok so at the moment I have the UK birth registration already applied for in the UK and is in process. (this may explain why i have a letter from them saying its been sent to bangkok :-/ )

so correct me if im wrong please (wont surprise me if i am) but what i will do is with his thai birth certificate and english translation is apply for the passport with the C2 form in BKK then apply for the settlement visa after i get the passport as on the C2 Form notes it seems i need to supply My Full birth certificate aswell as my sons birth certificate and my marriage certificate (which is all being used in my wifes visa application)

im probably confusing the issue but:

the way i see it on the C2 Form notes its sayin if he is born outside the uk

I just need the child’s consular birth certificate

OR

if parent(s) were born in the UK (i was )

I need the full UK birth cert and B or C.

C being :

(If the father#/adoptive father only was born in the United

Kingdom* or a qualifying territory, his full birth

certificate, full marriage certificate and evidence)

relevant C2 Form notes for your convenience:

If the child was born OUTSIDE the

United Kingdom*, or OUTSIDE a qualifying

territory after 20 May 2002;

F. The child’s consular birth certificate: or

G. If the parent(s) were born in the United Kingdom* or a

qualifying territory documentary evidence as at B or C

above and the child’s full local or British Forces birth

certificate showing parents’ names: or

H. If neither parent was born in the United Kingdom* or a

qualifying territory, documentary evidence that the

mother is a British citizen otherwise than by descent,

e.g. naturalisation or registration certificate; or similar

evidence that the father# is a British citizen otherwise

than by descent, his full marriage certificate and

evidence of termination of any previous marriages.

No problem. I was going to do the registration/passport here in the UK, until I did some reading around and realised I should do it over at the Embassy in BKK.

You'll need to take your long birth certificate (ie the full one, not the smaller/short version), your sons translated birth certificate and your marriage certificate along to the embassy with the fee and the pictures. Don't worry, they won't keep any of your documents. Report to the guard house at the entrance and show them your passport and explain you are applying for a passport for your son. In the embassy building you have to go up to the first floor and hand over the form and your certificates. They will photocopy your docs, take payment (You don't need cash, they have a chip and pin card machine) and ask for a Thai address to courier the passport to when it is done. You can then take your certificates and use them in your wife's visa application. It should take about 10 to 14 days for the passport to be sent out to you.

If you take your Mrs with you, I don't think she will be able to go into the embassy grounds. My Mrs waited in the guard house with them as it was raining very heavily.

AH they "Dont" keep the Documents? this is what i did not know, that solves it
