Letting Thai Staff Go

Recommended Posts

I need to lay off some of my staff as I’m moving the business to Singapore and I’m unclear what the legalities of doing so are… hoping someone where can help!

Staff has been working for the company for 8 months.

Do I need to give them notice? If so, how much notice is required?

What amount of severance pay is due? This site says 30 days, however a friend of mine tells me 60 days is due. Any help with clarifying this would be much appreciated.

Thanks!

You could also read the Labour Protection Act:

http://aseanirnet.org/downloads/Labour%20P...0(Thailand).pdf

Chapter 11:

Severance Pay

*********************************

Section 118. An Employer shall pay Severance Pay to an Employee who is

terminated as follows:

(1) if the Employee has worked for an uninterrupted period of one hundred and

twenty days but less than one year, he or she shall be entitled to receive payment of not

less than his or her last rate of Wages for thirty days, or of not less than his or her Wages

for the last thirty days for an Employee who receives Wages on a piece rate basis;

...

So, 30 days notice + 30 days severance pay.
