Understanding The Thai Laws Between Thais

Recommended Posts

I recently got involved in a Discussion, regarding a Divorce between a Thai Couple, where the Husband

does not agree to the Divorce.

The Lady was speaking about a Lawyer, who could resolve this Problem for a certain Amount of Money -

but does it necessarily require a Lawyer in Thailand to get divorced after a certain Time of Separation ?

What are the Facts in this Case - and how to solve it, without paying a Lawyer?

I think is necessary to get a lawyer to helping until the divorce process finish, one of my Thai friend married with Thai man and they are not divorce even almost 20 years live separate and if my friend want to divorce she also has to take contact with lawyer, the cost is not cheap because her husband live in US but she live in Thailand.

Normally can divorce 2 choices, first choice is both spouse agree together to divorce and second is divorce by the court, this way you need lawyer and if separated more than 1 year (wife or husband abandon spouse) or more than 3 years (both agree for separation) can ask the court to get divorce.

My understanding is she can file for divorce by reason of abandonment after a period of 3 years. It does require a court appearance in a Thai court, and the husband is allowed to attend and contest this if he can be located and elects to attend. All Thai court appearances require a lawyer. You can not represent yourself.

This is what I learned when my sister in law just got divorced. There are several lawyers on the board though who can probably give you a more thorough answer.
