I want to confirm email between my X and her boyfriend; they both lied in court, which resulted in losing custody of my son. I never saw him for two years because of that. Basically she had the affair and left me with the kid, she came later and took him, I found him took him back and then took her to court; I should have gone back to the UK.

Before I submit a complete book to the courts I want to clear any doubt, which will force the courts to order the emails from the IP; then it will be perjury

I wanted to volunteer as a Polygraph instructor at the International Police Academy in Bangkok and the Director basically told me that the Thai police prefer to obtain confessions the "old" fashioned way :o

I do know that there are several security firms in Bangkok that do pre-employment and security testing for employers on a commercial basis but am not versed in how polygraph tests are viewed by the courts (both civil and criminal) in Thailand.

But as the previous poster stated, no where in the world, (that I know of) can a person be compelled to submit to a polygraph examination.

also (as a side note) regarding getting emails from an ISP.  Unless they saved them with the ISP, ISP's don't retain deleted emails, unless it's still sitting in the deleted box.  Services like Yahoo or Hotmail empty the deleted emails automatically every so often.  Since you are talking about thai ppl, I'm assuming that they use the basic yahoo or hotmail accounts as opposed to subscribing to a service and downloading the emails on their computer using outlook.....

I want the polygraph on myself, just to give the courts an understanding that I am and always will tell the truth. I have the emails sat on a server so they can be examined by a cyber expert.

But I would still seek the advice of an attorney on whether or not a civil court in Thailand will even consider polygraph evidence.

I have no trust in Thai lawyers, because my X and her boyfriend gave false statements, the courts looked for a reason to give her custody; they found it as my lawyer never took me to the welfare for an interview. I use a lawyer just because I have too; I have a very good translator (50 Thai 50 Germen) he was a translator in Germany and really knows his stuff. He even arranged a one to one with a judge and explained every aspect; the judge told me to give him evidence and I will win; hence my efforts to get these emails into the court.

If you have the emails already sitting on a server, why can you not get them off the server and present them to the Judge. Polygraphs are being accepted less and less these days I think as there is a very simple way to beat them. I hope it turns out ok for you and your son.

Remember though that perjury is perjury. Are they both guilty? If so then it will cause problems for your X.

Remember though that perjury is perjury. Are they both guilty? If so then it will cause problems for your X.

Thanks for you great advice, at the end of the day, I have to stand by my principles and allow the law to take it's course. I always find if you tell the truth then all should be fine. They even both stated that I never worked along with her sister; I had a good job back in the UK, but left that job and came to Th with 1.5 mil, I started my own company, renting an office in Bangkok. Because my X went to work full time for her boyfriend, and would not help me any further, I close my company and took employment for a fabrication company near Chonburi. I have all this paper work together, and now I am compiling a complete file; I should be finished next week and I will the go to the court to push for action.

I know it is not that simple; but I now know emails are allowed into court even if taken from her account, as long as I don't publish them.

I will keep all informed

You know-if the Thai court system works similarly to the courts of the US-polygraph results won't hold up. Rather, while they may influence a decision to prosecute, the results may not be used in court. For good cause, too, polygraph tests are unreliable and have probably resulted in unjust punishments for many people.
