It seems a little odd that the current PM would be discussing what Japan is doing regarding who can enter the country. If the Japanese didn't see fit to announce it, it doesn't seem that the Thai PM should do so. Unless, of course, he solved all those other problems. As said above she was innoccent her act was legal, But, a BIG but, be HE broke a law long on the books, not one put in place by the junta to nail him. He did it in broad daylight for all to see. The bit highlighted is the BIG but, Under the ORGANIC ACT ON COUNTER CORRUPTION (BE 2542), the only people who can be prosecuted under article 100, are those who are considered to be "Alleged culprits", whose crime would be considered sufficient to justify either a criminal conviction, due to malfeasance or corruption, or could be a basis for removal of office. In November 2006, the AEC Chairman tried to get this changed, so that an individual could be prosecuted purely on the basis of breaking the conflict of Interest rule as stipulated in Article 100, however this was ruled against by the NCCC, as they concluded that every individual that is covered by the NCCC Act could be guilty purely by carrying out everyday activities such as banking, telecommunications or having public utilities, and that the interpretation imposed when the NCCC was formed would have to remain in place. As such the AEC were forced to include 2 penal codes into the suit, even though they at no time called any witnesses to show that there was either any abuse of power, or malfeasance in office. (The only witness's called to the stand regarding the criminal aspect of the case were from one of the failed bidder's and representatives from the FIDF, all of whom were there to represent the accused,not the plaintiff, and each stated that the bidding was fair and totally transparant). The Prosecutions case purely rested on the fact that the FIDF was State Agency, and that Thaksin did have the power of Inspection. As you stated, she was innoccent, her act was legal, therefore the only conclusion that can be reached is that ALL the criminal aspects of the case were only included to facilitate the inclusion of Article 100 of the NCCC Act... PM Abhisit, speaking before leaving on a 3-day visit to Japan, said he had learned about the entry ban, but had not made inquiries with the Japanese authorities. Japan is the 2nd country to shun Thaksin who was sentenced to 2 years in prison for abuse of power. Britain has revoked the visas of Thaksin and his ex-wife, Potjaman, frustrating the ousted PM's bid to seek political asylum there. The latest entry ban was confirmed by a local Japanese diplomat who said Thaksin had not been allowed to enter Japan since late November last year. According to the diplomat, Japanese law states that anyone given a "final sentence" of more than 1 year in jail is barred from entering the country. The rule, however, is not applicable to people appealing their cases. "Under the Thai system, the case of former PM Thaksin is regarded as final since Thaksin did not appeal within a month from the court giving its verdict in October last year. So he could not enter the country after November 22, 2008," the Japanese diplomat said. The diplomat said the Japanese government did not make an announcement about it before because the law applies automatically to all foreigners regardless of profession and nationality. The law in question is the Immigration Control and Refugee Recognition Act's Article 5. "Because of the act, Thaksin, who was sentenced to 2 years by Thai law, shall be denied a visa or permission to land in Japan," said the source. Thepthai Senpong, personal spokesman for Mr Abhisit, said yesterday Washington and Beijing are also not happy welcoming Thaksin if the convicted former premier wishes to use their countries for political activities. Mr Thepthai said he was checking with the Foreign Affairs Ministry to find out if other countries were putting Thaksin on their blacklists. Pathetic. What a weasel. When his time is nigh and he sneaks back in to Chiang Mai (as he has stated he will do) I hope the authorities arrest him promptly and he dies in a lonely prison cell. PS. my apologies if my feelings appear too strong. BTW...his "close aides" must be thrilled to know they'll never be trusted by Thaksin because they're not "family". sriracha john Posted February 5, 2009 Share Posted February 5, 2009 (edited) Thaksin failing to file an appeal to his conviction had other repercussions, at the time, as his status became that of a definitively-convicted criminal (and also a fugitive)... such as the revocation of his diplomatic passport and it was also supposed to be the date of his Police Lieutenant-Colonel title being torn from him, although that has yet to be officially stripped through the proper channels. It also revoked his bail and he's lost his bail money. Possibly most importantly, however, is that by not contesting his guilty finding, he is finally admitting his guilt (no matter what he says subsequently) to the whole country as well as the world.... And now we have major countries blacklisting him because of it. I wonder if Thaksin was fully cognizant of all of this fallout from not appealing his case. I'm guessing he wasn't. But then when part of your legal defense team is locked up for bribing the Supreme Court and another has a prior conviction for contempt of court, others have been disbarred, and yet another was a Foreign Minister thrown out of office, good legal advice is hard to come by. Abhisit confirmed this was the case when asked to comment by reporters before embarking on a three-day official visit to Japan. Under Japanese immigration law, any person with a criminal conviction will not be allowed to enter the country. Thaksin's status in Japan had not been questioned in recent months because he had not sought to visit the country since a Thai court's decision last October to sentence him to two years in jail in relation to the Ratchadaphisek land case. The previous year, he had maintained a high profile in Tokyo as a guest lecturer at Takushoku University. The British government was the first to revoke his visa followed the court's ruling. Other countries have different visa regulations regarding persons with criminal records. Neither the United States nor China has revoked Thaksin's visa. According to an informed source, in the case of the US, Thaksin can still enter the country because the US does not have the same restrictions as the UK immigration authorities. However, after the expiration of his US visa, Thaksin will encounter difficulties in getting it renewed, the source said. When his diplomatic passport was revoked at the end of last year, Thaksin was unable to enter China without a visa. However, with his ordinary passport - the future of which the Foreign Ministry has yet to decide upon - he can apply to visit China, where he has vast business interests and links with influential people. Thaksin has been on the run since October, having popped up in various countries ranging from Dubai to Hong Kong. He has kept his hiding places secret whenever he phoned in to gatherings of his supporters in Bangkok. So long as Thaksin is on the run and subject to a Thai court's ruling, he will face difficulties in renewing the visas that he currently has, according to a senior Foreign Ministry official. Meanwhile, You Ay, the Cambodian Ambassador to Thailand, yesterday issued a statement dismissing a news report that a group of Pheu Thai Party MPs was planning to meet Thaksin in Cambodia's Koh Kong province. "With reference to the article titled "Pheu Thai Party MPs may meet Thaksin in Koh Kong," which was published [in The Nation], I have the honour to inform you that the Royal Embassy of Cambodia has no information at all about the visit of Thaksin in Cambodia," said the Ambassador. Chiang Mai MP from the Pheu Thai Party, Surapong Tohwijakchaikul has commented on Democrat MP Thepthai Senpong's statement made yesterday, calling it unproductive and saying it could create conflict in the country. Thaksin's personal political party now totally controlled by his own family members are upset that Thaksin cannot enter Japan because he is a criminal. I have to say the Dems are doing a pretty good job at winding up PTP and the red boyos these days. After Suthep's little presidential comment (wonder if he has a tape of what T's son said in the Chiang Mai bar), the challenge to do a phone a day, and thanking the red shirts we get the Japan ban, and anyone with a clue about how there are rather a few countries who dont let convicted criminals get a visa will relaise he is technically banned form a few more than just the UK and Japan. That probably explains why he doesnt travel much these days. Every time this stuff comes up his face takes another blow. So we have PTP MPs meeting Mr. T in HK and/or Cambodia and even rumours that Banharn's kids will too. Guess T has to try and force a change before it all comes crashing down.
