The prejudice against gays in the U.S. is clearly evident by this article in which pyschatrist tries to appeal to a juries prejudice that sex with a gay man by a "straight" man would genrate temporary "insanity" The "twinkie" defense with a new twist.

Imagine if this defense was tried with a gay man going temporarily insane after sex with a woman and then killing her.

"(Oshkosh, Wisconsin) A forensic psychiatrist has told an Oshkosh court that 'gay rage' exists and that a man was legally insane when he killed a gay Wisconsin man after having sex with him.

Gary Hirte killed in a “micro-psychotic episode” George Palermo told the court during Hirte's sanity trial.

He said that the "episode" was brought on by the "shame of realizing he had sex with another man".

The body of Glen Kopitske was found slain execution-style in his rural home in July, 2003.

Hirte, 19, already has pleaded guilty to murder. The issue now is sentencing.

His lawyer, Gerald Boyle, is arguing that Hirte should be sent to a mental institution, where he could petition every six months for release. If he's found sane, he faces life in prison for first-degree intentional homicide.

Earlier this week Boyle told the court that Hirte was tormented about his sexuality and confused about what was going on inside of him. (story)

According to Boyle, Hirte had "homosexual urges" that intensified after he drank alcohol, as he did the night of the murder.

He said Hirte had been drinking at home and went to a boat landing and sat on the hood of his car. Kopitske approached and invited Hirte to his house.

The men had oral sex and Hirte left and returned to his car. A few hours later he drove off in what Boyle described as an "unbelievable rage", got a shotgun and knife, returned to the house and killed Kopitske.

But, Dist. Atty. William Lennon says that planned the murder and did it to see how it would feel.

The case is expected to go to the jury on Friday."

The situation is an old classic- guys who go out looking to have sex with other guys, then have a homophobic guilt reaction and attack/accuse/assault them, in total denial- "look what you made me do!"

I feel sorry for guys who are so twisted they feel they should react this way- but they should have better control of their violence. If American society at large were less homophobic, we could probably avoid incidents of this type altogether. In Thailand, I think if straight guys happen to have sex with other guys, they just regard it as another way to get off!

Let's see: gay man decides to try having sex with a woman. Finds a woman, has consensual sex with her, then gets into a rage and kills the poor lady. Yeah, I don't think the guy would get put into a mental institution for that.

I asked a real ladyboy once (who was watching a hetero porno film at the time) - have you ever had sex with a woman? "NO!!" Would you like to try it? "NO, Maichai!" You might say that he reacted as if he'd be crazy to have sex with a lady.

(Oshkosh, Wisconsin) A jury has ignored claims that a Wisconsin man was murdered in a case of "gay rage" and ruled that Gary Hirte, 19 was sane when he killed Glen Kopitske in July 2003.

Hirte will be sentenced in March. He has already pleaded guilty to Kopitske's slaying. The only question for the jury was whether he was mentally incompetent at the time of the murder as his lawyer had argued or was sane and perpetrated cold blooded murder.

The conviction carries life in state custody but the judge can decide whether to keep Hirte in prison for life or set early date for supervised release.

Chris P, I thought 'maichai' was a general way to say 'no.' At least it often is in Northern Thailand, and my boyfriend confirmed it this week. If you want to say 'not something" you put mai followed by the thing (like subject or adjective, such as 'mai pet'). I don't know, so if you really need to know, check the Thai language forum here.

If the young guy is only 19 years old and in any way attractive (or even if he's not attractive) then he's certainly going to find out all about male sex once he gets to jail.

I almost feel sorry for him.....almost .
