Not true. Same-sex couples have no legal status in Thailand. It is common for them to have monks do religious "wedding" services, but these are not recognized by law. You cannot register a marriage between people of the same sex.

A couple of further comments:

1:

Same sex couples may have legal relationships in Thailand- but this would be on a private-basis. For example, you could name your same-sex partner as your legal heir.

On a goverment-level, however, PvtDick is correct - for example, you could not (currently) claim any tax deduction on account of your live-in partner in the same way as a husband can for his wife.

But, this does not debar you from naming, in a private document, that your same-sex partner is your heir/guardian. Moreover, if you are in a same sex relationship, and this is what you would like to do, it strongly recommended that you have both a will and living will setting this out. Failing which, the statutory law will not recognise your same-sex partner as an heir to your estate (in Thailand).

2:

No "monk" religious cermony is recognised at law - even between couples of opposite sexes. It the amphur or nothing. And, in the case of male-male/female-female relationships, currently it is nothing.

3:

You cannot register a marriage of people who were born the same sex (i.e. in their birth certificate). Fact they've had a sex change and are now a woman is not the issue - if the birth certificate says male (even if they are born female), that's what they are. I believe this also applies to transexuals.

All the rules pertaining to marriage and inhertiance in Thailand are set out in the Civil and Commerical Code - under "Family". I'm not a lawyer, but if you have not read this I would urge you take a quick review - see what may be important to you - and then seek consultation with a legal adviser.

It is not outside the realm of possibility, that Thailand will "recognize" a valid same sex marriage, legal in other countries for immigration purposes, especially if it is a local official waving a financial requirement for a retiree and allowing a 400k vs. 800k sum, especially if "tea money" is involved.

While Thailand's laws are "code" as opposed to "commn" law, the strictness of the interpretation is so lax and enforcement so spotty, anything is possible.

I would suspect that a hospital administrator presented with a valid extra-territorial marriage certificate between same sex marrieds would certainly allow full spousal benefits to the same sex partner.

I would sure like to hear from someone's actual expereince when presenting a valid extra-territorial same sex marriage certificate to a Thai official and what occured as a result. I doubt it has happened yet!!!
