Land Title Deeds

I hav the option to buy a property having the Nor Sor 3 Gor deed to it.

(A land awaiting a full title deed is granted the document Nor Sor 3 Kor. The land is measured by the Land Department; therefore, it has its exact boundaries. The owner knows exactly what he owns. This type of land may be sold, transferred, or mortgaged, as a land with freehold title deed (Chanote). The owner of the land may file a petition to the Land Department demanding to change it to a full title deed (Chanote), and the Land Department may do so if there is no opposition made against the petition.)

Do I understand it right that I own the land but I am not allowed to do with it what I want and that changes are depending on governement approval. Are there other options around that or is it really neccesary to upgrade to a Chanote.

You are aware foreigners can not buy land in Thailand? Nor can your money be used to buy land.

also not when i am legally maried to a thai wife

You as a non-thai can NEVER own land (except under very special circumstances).

Your Thai wife can of course, however she must purchase with her own funds (it is unclear if you can gift the funds), either way you will have to sign a document stating that you have no call upon said land in the event of a marriage breakdown.

Nor Sor 3 Kor

Is a certificate issued by the relevant local Land Department Authority certifying the usage of land of the person entitled thereto. An aerial survey photo of the land has been taken which makes Nor Sor 3 Kor different from Nor Sor 3. The result of having an aerial survey photo is an ability to identify the exact position of the land boundary.

The person whose name appears as the owner of Nor Sor 3 Kor has a right to transfer, sell, dispose of and mortgage the Land upon registration with the relevant local land department in accordance with the Land Code and other regulations, notifications and announcements relating to it. Any transaction in connection with the real property (except where the lease is not more than 3 years) must be registered with the relevant local land authority and will be shown at the back of Nor Sor 3 Kor.

As usual due dilligence applies, before parting with my hard earned cash I would make sure there are no restrictions on land usage that would prevent me using the land as I wish, if such restrictions are in place , why bother buying it?

The only difference between Nor Sor 3 Kor (Ghor) and Chanote is how the land was measured. The Chanote titles are all measured using GPS. Thai is all! Hence, the Nor Sor 3 and Nor Sor 3 Kor are as good as Chanotes but, as someone pointed out, precautions should allways be made to ensure that the title is clear before making any purchase.

Any hinder to the title can be seen on the back side of the title document. Further, the Nor Sor 3 titles have green coloured garudas while the Chanote has a red garuda.

If one were leasing land for a business, and planning on a 10 year commercial lease, any informed opinions, please on if this is legal without registering it?

Nor Sor 3 gor

A lease longer than 3 years has to be registered with the Land Office to be valid. And tax to be paid.
