I dont know if there is any advice here but much appreciated:

- I have been living in Thailand for 20 months and I have a 9 month old daughter with the Mrs. We want to go to the uk for christmas. My Mrs is previously married to a Scottish guy and she has been trying to get a divorce for ages (before she met me).

He is not contactable now. So she is still married. Also, she has been refused entrance to the UK twice (2004(tourist visa) & 2007(settlement)). My dad is going to sponser her.

Will this be easy to get her to the UK with us having a child together or does it not make a difference?

Will the past declines of VISA affect this process?

Why cant she get a divorce without that guy being in Thailand?

Any help....

Firstly, you are the sponsor, not your dad; although your dad can provide accommodation and financial assistance.

You should write a sponsor's letter outlining a brief history of your relationship, the reason for her visit to the UK at this time and what your future plans are together. You should also include details of your and her reasons for returning to Thailand, e.g. jobs, as you want to make sure they are satisfied that she will leave the UK at the end of the visit. A copy of your passport showing your immigration status in Thailand will be of great help.

Whoever is financing the trip needs to provide evidence of their ability to do so; bank statements, pay slips or similar.

Whoever is providing the accommodation needs to provide details of that accommodation to show there is room for the three of you. As the child is an infant, she can share a room with you and your partner. They should also provide evidence that they can grant you permission to stay there; a mortgage statement or copy of the deeds if they own or a letter from their landlord if they rent.

Each application is judged on it's own merits, so her previous refusals should not affect this application. Unless the reasons for the refusals have some bearing upon her current situation or she was refused for submitting a fraudulent application.

Sorry, I have no idea about divorce law in Thailand, except that it is easy to do if both parties turn up at the Ampur; which doesn't really help in your situation!

If her husband is out of the country and has no interest in returning to Thailand, your lady needs to see a divorce lawyer. The lawyer will need to petition the court on her behalf for a divorce (probably stating that the marriage has broken down due to abandonment by the husband). The court will then write to the husband at his last known address stating that his wife is asking for a divorce, the husband will be given x amount of day to reply to the letter. If no reply is received from the husband by the end of the said date, then the court will grant her divorce. Costs: this is a tricky one as most lawyers seem to make fees up as they go along. It could cost her as little as 5000 Baht and as much as 50,000 Baht (she needs to shop around to find a lawyer that not only knows what he is talking about, but also will not rip her off). Are you sure you know what you are doing?

Me thinks that this isn't going to work and you're being taken for a ride hook line and stinker.

Get a hold of yourself man and think about the consequences if it's just one big con.

And no one on this forum is saying the obvious. Stuff like this gets up my nose and all these visa forums do is help yet another economic migrant into the UK.
