Hello all.

Sorry if this isn't the correct area to post but I thought most likely!

Me and my mrs are in a bit of a pickle with her ID card and passport.

We are married and have got all the UK settlement visa stuff in order except for her new passport and TB check. She has fallen out with her aunt and her name is down on her aunties tabien baan as living at her address in BKK. She has moved to her friends family home at the moment but I am unsure of the following:

She took my surname whenwe registered our marriage at the amphur and I am unsure that since we decided to do this will she have to get the tabien baan changed to her first name + new surname in order to get new ID card and passport (hers expires in4 moths)?

If this is the case does anybody have a clue as to what can be done if her aunt will not cooperate in going with her to the local amphur to change his details? Can she go to her friends local amphur and use the fingerprint details to confirm who she is in order to be put on her friends tabien baan to then get the necessary new ID and passport or is not possible?

Is it necessary for her to change her ID card and passport to my name seeing as the wedding certficate states her as taking my name?

Her aunt seems h*llbent on making things as difficult as possible for us and it is driving me up the wall! :-)

Apologies for the long spiel but I think that's everything covered.

Any advice or similar experience info would be a great help and much appreciated!

As far as any UK visa application is concerned, there is no need for a wife to take her husband's surname on marriage, nor any need to change her passport or ID card. Your marriage certificate will show that she is married to you.

She does not need to include a tabien baan in her visa application.

What the situation is regarding Thai law, I'm afraid I don't know.

I think maybe my first post was a bit muddled and did not convey the exact info i am in need of.

I am aware that there was no need for her to change her surname to my surname but she wanted to do this.

lets call her noi jaidee and call me john maclean.

Does the marriage certificate state that "miss noi jaidee has married with mr john maclean and has taken the name maclean, she is now to be reffered to as mrs noi maclean" ?

If this is the case, will her ID card and passport need to show that she has changed her name to maclean, or will her current card and passport with the name noi jaidee suffice?

If she does have to change her ID card and passport (which she has to do anyway as it expires pretty soon) will she need to take the tabien baan to her amphur to get her name changed to noi maclean on the tabien baan in order to get a new ID card and passport with the name noi maclean.

 

Finally, if she does not have to change her name on the ID card and passport, but needs to renew her passport, will she require to bring her tabien baan to get the new passport or can she just bring her ID card and old passport?

No the Marriage certificate does not say this.

My wife was given another sheet of paper at the Amphur, whilst getting her ID card, to say that she wanted to change her

surname and use mine. Again this was at the local Amphur, which was not the same one as we got married in. This was also

used for her Passport application.

So the marriage certificate just says that “noi jaidee has married with john maclean” it will still have her family name not my name?

 

This being the case, will she need to bring the tambien baan to the MFA to get a new passport? If so we are farked as her dang aunt will not play ball!

According to my wife;

She does need the tabien baan to change the name on her id card; but she does not have to change the name on her id card on marriage unless she has been married before and the card is in her ex husband's surname.

She does not need the tabien baan to renew her passport, just the old passport and her id card; but the name on the new passport will be the same as on her id card. As said, having her passport in her maiden name is not a problem as far as UK visas or immigration is concerned.

If she does want to change her id card and finds that the ampur wont do this without the tabien baan then all my wife can suggest is that, if she can't make it up with her aunt, she explains the situation to the ampur and sees what advice they can give.
