Hi again.

After going through the Indefinite Leave to Remain guidance notes and form, I am very concerned with regards to the documents they are asking us to provide.

The only documents we have with my wife's name on are a letter from the NHS and a PAYE notice from HMRC.

My wife works part-time but is paid in cash, she doesn't earn enough to pay tax and she doesn't have a bank account. The house is in my name and I pay all the bills so all of these types of documents are in my name. She doesn't drive etc.

Any advice as to our best course of action here would be very much appreciated.

Thanks

Remember that you only need 6 documents from at least 3 different sources; so two letters from the same source are acceptable. Ideally they should be addressed to you both jointly, but a mixture of ones addressed to you and her singly is acceptable. The dates of these documents must cover the whole two years.

She has a letter from the NHS, what about a medical card? That should have her address on it.

She has a PAYE notice from HMRC, what about a NI number letter from the DWP? Even if her earnings are below the threshold for tax and NI contributions, she should still have a NI number if she's working.

Does she have a mobile? Whose name is the account in?

Section 10 of the application form gives further examples, and also contains

Please give an explanation on a separate sheet if you cannot provide 6 items

Ok, so she's now managed to find her NHS medical card as well, which is dated Aug 2008. So, in total, she has her NHS medical card, letter from the NHS regarding some screening, but it doesn't have a date on it, and a letter from HMRC regarding her 2010 tax code.

Her employer also has all her pay slips from July 2008 but they don't have our address on them, just dates. Her employer has also offered to write a letter.

I have bank statements, pay slips, utility bills for the last 2 years all only in my name. I guess I could ask the utility companies to add my wife's name to our bill and send a recent copy, would that help ?

If I write a letter explaining that all our bills are in my name as I pay them, should that be sufficient ?

Many thanks for your help, it's most appreciated.

I don't see how a letter from her employer will help, but it wont hurt. If you are renting then a letter from your landlord will be better. If buying, did you inform your mortgage provider that she is living in the property, and if so did you receive a letter from them confirming this?

Changing your utility bills now wont help, as this would only show she is living at the address now, not had been for the last two years.

Are you sure you cannot find the letter from the DWP issuing her NI number?

However, you have three documents in her name and three in yours. Providing they cover the whole two years this should be sufficient. But you should include a letter saying why you cannot provide documents in joint names.
